<br />f. <br /> <br />. <br />J. <br /> <br />_.,:t _".!.: ,~ ~ <br /> <br />... <br />"" <br /> <br />ORDINANCE NO. ~54 <br /> <br />VILLAGE OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE REGULATING THE OPERATION OF SNOWMOBILES IN THE VllI.AGE <br />OF NEW BRIGHTON AND PROVIDI~ PENALTIES FOR VIOLATION THEREOF. <br /> <br />The Village Council of the Village of New Brighton does ordain: <br /> <br />SEctION 1. IN'l'ENl'. It is the intent of this O1:dinance to supplement <br />the laws of the State of Minnesota, Chapters 84.81 through 84.88, and 'Chapters <br />168 through 171. Minnesota Statutes, with respect to the operation of snow- <br />mobiles. This ordinance is not intended to allow What the state statutes <br />prohibit nor to prohibit What the state statutes expressly allow. <br /> <br />SECTION 2. DEFINITIONS. <br />(a) SHlWMOBLIE. Snowmobile means a self-propelled vebicle designed <br />for travel on snow or ice or natural terrain steered by wheels, skis or runners. <br /> <br />(b) OPERAIE. Operate means to ride 1n or on and control the operation <br />of a snowmobile. <br />(0) OPERATOR. Opf:rator means every person who operates or is in <br />actual pbysic&l control of a snowmobile. <br />(d) ROADWAY. Roadway means that portion of the highway improved, <br />designed or ordinarily used for vehicular traffic. <br />(~) OWNER. Owner means a person other than a Uen holder, having <br />the property in or title to a snowmobile and entitled to the use or possession <br />thereof. <br /> <br />SECTION 3. OPERATION REGULATED. <br />It shall be unlawful for any person to operate a snowmobile within <br />the Village of New Brighton in violation of any of the following regulations: <br />(a) Such snowmobile shall be currently and validly regtstered with the <br />State of Minnesota and conspicuously display its registration number in accordance <br />with State Law. <br /> <br />(b) To operate a snowmobile: within 100 feet of a residential building between <br />the hous of LL:OO ~.M. and 7:00 A~ M. exc~pt with the permission of adult <br />occupants of such building or except when travelling in a direct route from a <br />permlssable area for snowmobiling and the home of the operator. <br /> <br />(c) To operate a snowmobile upon any lands, except public right-of-ways, <br />owned by the Village of Hew Brighton, County of Ramsey, State of Minnesota or <br />School District unless permission fo do so 1s lawfully posted upon such land. <br /> <br />(d) To operate a snowmobile upon any privately owned lands without the consent <br />and permission of the owner of said lands. <br /> <br /><e) To operate a snowmobile during the hours between one-half hour before <br />sunset and one-half hour after sunrise without the required headlight and tail <br />light being illuminated. <br /> <br />(f) To operate a snowmobile at a rate of speed greater than reasonable or <br />proper under the surrounding circumstances. <br />
