/~®ti <br />./" <br />JOINT POWERS AGREEMENT <br />RELATING TO <br />MAINTENANCE AND OPERATION <br />OF LONG LAKE/RUSH LAKE REGIONAL PARK <br />This agreement is made this 13~ day of ~. , 198, between <br />the County of Ramsey, State of Minne ota (.County) and City of New Brighton, <br />County of Ramsey, State of Minnesota (City). This agreement is entered <br />into pursuant to Minnesota Statutes Section 471,59 (1980). <br />Whereas, Long Lake/Rush Lake Regional Park is currently owned by <br />the County, and other portions have been owned by the City, and <br />Whereas, both parties recognize the regional significance of the <br />Long Lake/Rush Lake parks, and <br />Whereas, the County has been designated "implementing agency" to the <br />Metropolitan Council for Long Lake/Rush Lake Regional Park, and <br />Whereas, the County and City have engaged in negotiations to rectify <br />the problems created by dual ownership of Long Lake/Rush Lake Regional <br />Park, and <br />Whereas, both parties recognize that the uncertainty of funding of <br />maintenance and operation costs of the regional park has been an impedi- <br />ment to these negotiations and also to development of the park, <br />The County and City hereby enter into this agreement regarding opera- <br />tion and maintenance costs for the purposes of expediting the development <br />of Long Lake/Rush Lake Regional Park and easing the problems creating by <br />dual ownership of the park, and hereby agree as follows:,. <br />1. The City shall, at its sole expense, provide the maintenance <br />and operation services listed below: <br />a. The City shall provide police services and the attendant <br />attorney services necessary for prosecution of misdemeanors <br />for the entire Long Lake/Rush Lake Regional Park. <br />b. The City shall provide fire protection services for the <br />entire Long Lake/Rush Lake Regional Park. <br />c. The City shall continue to conduct a public beach operation <br />on Long Lake and be wholly responsible therefore. The <br />beach operation includes, but is nqt limited to, maintenance <br />of the beach area, provision of lifeguards, and operation <br />of concession stands or clubhouse facilities, if any. Any <br />receipts obtained by the City for such concession stands <br />or clubhouse ..facilities may be retained by the City. <br />d.
