Harmon inquired if the Post Office Service was still on track for moving to its new location as <br /> long as they receive the higher amount to move. Fernelius replied that was correct. Harmon <br /> inquired why there was a split vote on the approval of using eminent domain on the post office. <br /> She asked if the council members who voted against using it, wanted the tax payers to pay the <br /> higher asking price for the property. Bauman replied that she has a belief that eminent domain <br /> should not be used. Larson stated two members of the Council share the philosophy that eminent <br /> domain should never be used. Kaufhold asked if there had been a recommendation if eminent <br /> domain was not to be used. Larson replied that there was no other recommendation other than <br /> paying more. Larson added that the City could do a quick take on the property. Kaufhold asked <br /> why the City has not decided to take that route. Fulton replied that there is no advantage to <br /> doing a quick take over the traditional condemnation. <br /> Railroad <br /> Fernelius reported that the City has been negotiating with Minnesota Commercial Railroad and <br /> MT Properties on abandonment of the Butchers Spur and the relocation of the wye. The City <br /> recently prepared a three party agreement that outlines the process of the abandonment of the <br /> Butchers Spur and what the City will provide for a replacement of the wye at the USF Dugan <br /> site. The City is now waiting on comments from the both companies. The City is not <br /> anticipating any issues; the owners are looking for compensation for the land and replacement of <br /> the spur track,which is what the City is offering. <br /> Fernelius stated that the City still has access to the $1 million from the state to relocate the wye. <br /> Nelson inquired if the $1 million will cover most of the expense of the replacement for the wye. <br /> Fernelius replied that it does cover the construction of the wye,but not the functional <br /> replacement or the land acquisition. Flahave inquired if the City knew of any land that could be <br /> swapped for the three acres that the City needs for the wye. Fernelius replied that he does not <br /> know of any available land in the area that could be swapped out. <br /> Fernelius announced that the City recently had a meeting with the proposed buyer for the USF <br /> Dugan site. They have told the City that they are interested in the whole site and would not be <br /> able to carve off the three acres the City needs to relocate the wye. The prospective buyer has <br /> the next 60 days to do their due diligence on the property. During that time period the City will <br /> decide if an agreement with the buyer can be reached or if eminent domain will need to be used. <br /> There may be an issue if the City takes the three acres; it may diminish the value of the land, if <br /> that occurs the City could be forced to purchase the entire site. <br /> Kaufhold inquired if holding pond could be swapped out to another site. Fernelius replied that <br /> the pond was designed to serve that location and could not be moved. <br /> Ferrellgas <br /> Nelson inquired if Ferrellgas could be moved to the USF Dugan site. Fernelius replied that the <br /> City has not approached Ferrellgas about that site, because the property is not under control of <br /> the City. He added that while Ferrellgas would prefer to keep its retail and storage sites together, <br /> they have stated that they are willing to separate the two. The City did recently meet with a <br /> company who is interested in building in the Northwest Quadrant, who may have a possible <br /> location for Ferrellgas to move too. <br /> Page 2 of 5 <br />
