An easement is granted and filed for municipal access to the storm sewer line that <br /> is proposed to be relocated around the southeast corner of the proposed building. <br /> 5. The applicant submits a revised landscape plan that incorporates the <br /> recommendations of the City Forrester, which are noted within this report. <br /> 6. Any change of use would require a Special Use permit. <br /> 5 Ayes, 0 Nays. MOTION APPROVED. <br /> Public Hearing: Zoning Code Amendments to Section 7-220 (1) and Section 7-230 (8) <br /> Planned Developments <br /> Recommendation that the Planning Commission re-open the public hearing from the <br /> February 21, 2006 meeting to consider an amendment to the Zoning Code to create a new <br /> zoning district for the entire east side of Old Highway 8 and the office outlot on the west <br /> side of Old Highway 8 within the Northwest Quadrant. The purpose of this ordinance is <br /> to codify the design guidelines within the Northwest Quadrant Framework Plan that was <br /> most recently amended in December of 2005. Creation of this ordinance is an important <br /> first step in the development progression on the east side of Old Highway 8 and also to <br /> aid staff, the Planning Commission, and the City Council in reviewing future projects for <br /> conformance with the NWQ design guidelines. <br /> Baker inquired what the statement "in permanent buildings only"means. Carlson replied <br /> that the store owner would not be able to set up a tent or cart outside on the sidewalk. <br /> Baker asked if it should be in or is it in an ordinance instead of in the guidelines. <br /> Fernelius replied that they would have to look at the ordinances to see if this <br /> circumstance would be covered. Carlson recommended to keep the wording as it is and <br /> to have provisions for temporary sales elsewhere in the code. Schiferl stated that there is <br /> not an item for special uses under the Al district. Carlson added that in a previous <br /> version there was a statement from the Mixed Use Zone that stated: the City Council <br /> shall consider other uses not listed in this section, such other uses may be granted, if in <br /> the opinion of the City Council, the use is compatible with other uses in the district. Zisla <br /> replied that when that statement was added to the MX, they were vague because there <br /> was not a defined plan for the Northwest Quadrant, however, now there is a sense of what <br /> type of retail they would like to see in the development. He recommended that they add <br /> language saying "same and similar" and then have a definition of what that would be. <br /> Baker agreed and added that would allow for some flexibility. Schiferl suggested they <br /> add a number nine to the code for district Al street level that states: Retail service uses <br /> C:ADocuments and Settings\igoepe l ocal Settings Tempo] Internet Files\O1 K2/3 03-21-06 minutes(2).doc <br />
