Approved <br /> Motion by O'Brien, Second by Schiferl WAIVE THE READING AND ADOPT THE <br /> ATTACHED RESOLUTION RECOMMENDING APPROVAL TO THE CITY COUNCIL WITH THE <br /> FOLLOWING CONDITION: <br /> 1. The current shed be moved to meet the R-1 setback requirements. <br /> Baker stated that in the staff recommendation it states a thirteen foot setback and it <br /> should state a twenty-nine foot setback. <br /> 6 Ayes, 0 Nays. MOTION APPROVED. <br /> Public Hearings: NC06-02 and VN06-04 Type 4 Non-Conforming Use Permit <br /> recognizing side yard setback not meeting the requirements and a variance to allow <br /> an addition in the front yard setback. <br /> The subject site has a single-family home that encroaches into the side yard setback at 3.6 <br /> feet where 5 feet is required. The owner wishes to construct an addition to the house and <br /> garage that would encroach into the front yard setback at 17.2 feet where 30 feet is <br /> required. The proposed garage Staff believes issuance of a Type-4 Non-Conforming Use <br /> Permit and Variance is appropriate because the impact of the non-conformity appears to <br /> the minimal on the surrounding properties. It appears the addition will likely enhance the <br /> home and will not have a detrimental appearance upon adjacent properties or the <br /> neighborhood in general. <br /> Doug Isiminger, homeowner, stated that if there was another location to put the attached <br /> garage they would, however this lot is very narrow with no other site to place it. Hans <br /> Rosacker, lives to the north of this property, has no objection to the addition of this <br /> garage, and hopes the Commission will approve the application. <br /> Motion by Baker, Second by Schiferl to CLOSE THE PUBLIC HEARING. <br /> 6 Ayes, 0 Nays, MOTION CARRIED. <br /> Schiferl inquired if staff had heard from the residents to the south of the property. <br /> Fernelius replied that staff did not hear from the neighbors to the south of this property. <br /> Baker stated that they have approved several applications that are similar to this on lake <br /> lots, due to the older homes, smaller lots and there are a number of properties that do not <br /> meet the front yard set back. <br /> Motion by Zisla, Second by Mann to WAIVE THE READING AND ADOPT THE ATTACHED <br /> RESOLUTION RECOMMENDING APPROVAL TO THE CITY COUNCIL. <br /> 6 Ayes, 0 Nays.
