Approved <br /> Public Hearings: SP 05-17 Special Use Permit for a proposed detached garage larger than <br /> 624 sq.ft. <br /> Consideration of a special use permit to allow a garage larger than 624 sq. ft. on a single family <br /> lot at 557 5th Avenue. Section 4-530(K)states that any structure larger than 624 square feet is <br /> subject to approval of a Special Use Permit. The Applicant is seeking a Special Use Permit to <br /> allow the existing 26'x 46' detached garage(1,196 sq. ft.)to remain. The applicant is proposing <br /> to construct a single family house on the lot which will bring the property into conformance with <br /> the city's zoning ordinance. <br /> O'Brien inquired if the drive way was brought into conformance if the existing garage would be <br /> accessible. Pat Siwek-Murzyn,the owner of the property, stated that there will be a twenty-two <br /> foot swing clearance even after the setback is met, so there should be no problem accessing the <br /> garage and the existing house has a tuck under garage. Schiferl asked staff what would happen if <br /> the house could not be brought into compliance by the end of June. Fernelius replied that the <br /> applicant would be in non-compliance with the special use permit,which would then go back <br /> before the Council who would have the opportunity to re-look at the special use permit and <br /> possibly grant an extension. Siwek-Murzyn stated that she was not aware of the June 20 dead <br /> line;the storm caused delays with getting the project underway,and does not believe that they <br /> will be able to have the house completed by that time. Fernelius stated that the dead line is the <br /> staffs recommendation,but that the Commission can suggest a different date. O'Brien stated <br /> that he believes that August 30 would be better dead line. Siwek-Murzyn replied that they would <br /> be very comfortable with that date and they would be able to meet that dead line. <br /> Howard asked if the staff had received any calls regarding this building, and if the Commission <br /> would be recommending demolition of the garage. Fernelius replied that the staff had received <br /> no calls regarding the garage,but staff had,through the course of doing research for building <br /> permit, discovered that the garage exceeded the zoning regulations. After consulting with the <br /> City's attorney,it was recommended that the City obtain a Special Use Permit acknowledging the <br /> garage. <br /> Motion by Baker, Second O'Brien by to CLOSE THE PUBLIC HEARING. <br /> 5 Ayes, 0 Nays,MOTION CARRIED. <br /> Motion by Schiferl, second by Zisla to WAIVE THE READING AND ADOPT THE ATTACHED <br /> RESOLUTION RECOMMENDING APPROVAL OF SP 05-17 with the following condition: <br /> 1. The property is brought into conformance by constructing a single family house no later <br /> than August 31,2006. <br /> 5 Ayes, 0 Nay.
