Page 1 <br /> PLANNING REPORT <br /> DATE: October 18, 2005 <br /> CASE: VN05-03 <br /> SUBJECT: Front yard setback variance and Type 4 Non-conforming use permit to <br /> expand the existing single family home at 2830 Forestdale Road <br /> APPLICANT: David Long, of Murphy Brothers <br /> BACKGROUND <br /> To consider a new site plan for the single family parcel at 2830 Forestdale Road. On September 20, <br /> 2005,the Planning Commission considered the request and recommended approval of a type 4 non- <br /> conforming use permit and recommended denial of a front yard setback variance to the City Council. <br /> On September 28th, the Council approved the non-conforming use permit and tabled action on the <br /> variance request. The applicant presented an alternate plan on September 28th; the Council directed <br /> the applicant to review the new site plan with Staff and the Planning Commission. <br /> REQUEST <br /> The owners also wish to add a third stall on their garage which would encroach into the required 30 <br /> front yard setback by 9 feet; which is the same distance the existing structure encroaches into the <br /> front yard setback <br /> If approved, the new garage wall would be 21 ft. from the front instead of the required 30 ft. This <br /> request requires a variance. <br /> FINDINGS <br /> Section 4-040 (3)Minimum Yard Setbacks for buildings <br /> Section 8-210,Variance <br /> SITE CHARACTERISTICS <br /> 1.
