STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL of SP 2006- <br /> 007. <br /> WHEREAS,an application for a special use permit has been made by Kari Brown of KTB <br /> Consulting, Inc. on behalf of T-Mobile to permit construction of a 100' <br /> monopole wireless telecommunication tower, and <br /> WHEREAS,the procedural history of the application is as follows: <br /> 1. An application for a Special Use Permit was filed with the City of New <br /> Brighton on April 26, 2006. <br /> 2. Public hearing notices for the Special Use Permit were published in the New <br /> Brighton Bulletin on May 3, 2006. <br /> 3. Public hearing notification was distributed to all property owners within 350' <br /> of the subject property. <br /> 4. The Planning Commission, pursuant to published and mailed notices, held on a <br /> public hearing on May 16, 2006. <br /> 5. The Planning Commission recommended conditional approval to the City <br /> Council for the Special Use Permit on May 16, 2006. <br /> NOW THEREFORE BE IT RESOLVED, the Planning Commission makes the following <br /> Findings of Fact in respect to SP 2006-007: <br /> 1. The subject property is zoned I-2, Heavy Industrial. <br /> 2. The subject property is guided in the New Brighton Comprehensive Plan as <br /> Industrial. <br /> 3. The applicant is requesting a Special Use Permit to allow construction of a <br /> wireless tower in accordance with the following conditions noted within <br /> Section 4-600 (2): <br /> a. All towers and antennae shall have setbacks equal to or greater <br /> than the height of the proposed structure. <br /> b. The distance of any guy anchorage or similar device shall be at <br /> least ten feet from any property line. <br /> c. Suitable protective anti-climb fencing and a landscape planting <br /> screen shall be provided and maintained around the structure and <br /> accessory attachments. <br /> d. The applicant shall present documentation of the possession of any <br /> required license by any Federal, State, or local agency. <br /> e. No structure shall be in excess of a height equal to the distance <br /> from the base of the structure to the nearest overhead electrical <br /> power line which serves more than 1 dwelling or place of business, <br /> less five feet. <br /> f. Only one such structure exceeding the district height limitations <br />
