RESOLUTION NO. <br />07-033 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />APPROVING OF THE VACATION OF EASEMENTS LOCATI~D ON THE PARCEL AT TFIE NW <br />srx AVENUE NW AND 15~ STREET NW AND LSO 300 SOH AVENUE NW. <br />~$ERE ,the Planning Commission, pursuant to published and mailed notice, held a public <br />hearin on April 17, 2007 to consider the vacations. All persons present at the hearing were <br />given opportunity to be heard; and <br />THERE ,the City, as petitioner, is the owner of the land located at the NW corner of Sth Avenue <br />NW 1st Street NW (Parcel 1) of which several of the easements are located; and <br />THERE , Dalco Enterprises, Inc, a co-petitioner, is the owner of the land located 300 Sth Avenue <br />NW ( cel 2) of which the perimeter Drainage & Utility Easements were dedicated as part of <br />the B HTON CORPORATE PARK V plat; and <br />Now, T BEFORE BE IT RESOLVED, the City Council makes the following Findings of Fact with <br />respec o the proposed Easement Vacations (EV2007-001): <br />1. Th subject area is zoned I-2, Heavy Industrial. <br />2. Th properties are legally described as follows: <br />.el 1: NW corner of Sth Avenue NW & 15t Street NW: <br />at C, BRIGHTON CORPORATE PARK III, according to the recorded plat thereof, <br />situate in Ramsey County, Minnesota <br />arcel 2: 300 Stt' Avenue NW: <br />.ot 2, Block 1, BRIGHTON CORPORATE PARK V, according tv the recorded plat <br />iereof, and situate in Ramsey County, Minnesota. <br />3. Th City of New Brighton has determined that the easements no longer serve a public <br />p ose or are a duplicate of an easements dedicated on the plat known as BRIGHTON <br />C ORATE PARK VII. <br />4. Th easements to the vacated are as follows: <br />P el 1: <br />Doc. #556250 <br />. Doc. # 17965 $0 <br />Doc. #150497$ <br />Doc. # 1504979 <br />P e12: <br />.
