RESOLUTION NO. <br />07-03b <br />STATE OF MINNESOTA <br />COUNTY OF RA,MSEY <br />CITY OF NEW BRIGHTON <br />RESOL <br />MAKING FINDINGS OF FACT AND APPROVING A SITE FLAN. <br />~$ERE , an application has been made by Ryan Companies, on behalf of the City of New <br />Bright fox consideration of a Site Plan application in order to construct an <br />office/ arehouse/showroom building consisting of approximately 57,806 s.f. at the property <br />locate t the NW comer of 5~' Avenue NW and 1St Street NW. <br />rxERE ,the procedural history of the application is as follows: <br />1. An application for a Site Plan Review was received on March 30, 2007 from Ryan <br />Co parries on behalf of the City of New Brighton. <br />2. Th Planning Commissian reviewed the request on April 17, 2007. <br />3. Th Planning Commission recommended approval of the Site Plan application. <br />4. Th City Council reviewed the request on Apri124, 2007. <br />~H>JRE ,the Planning Commission and City Council make the following bindings of Fact with <br />respec o the Site Plan (LP2007-004): <br />1. Th property is currently vacarlt. <br />2. Th property is a former superfund site. <br />3. Th property is zoned I-2, Heavy Industrial. <br />4. Th property is guided in the Comprehensive Plan for Business Park. <br />5. Th property is legally described as follows: <br />Lo 2, Block 1, BRIGHTON CORPORATE PARK VII <br />6. A quate Drainage and Utilities Easements exist and were dedicated on the plat in <br />an ' ipation of this proposed site plan. <br />7: Th total platted property area is 4.33 acres. <br />8. Th Planning Commission recommended approval of the Site Plan following review of the <br />pr ect per Zoning Code Section 8-010. <br />9. T City Council concurred with the Planning Commission's approval recommendation <br />re ding conformance with the requirements of Zoning Code Section 8-010. <br />10. T Planning Commission and City Council reviewed building setbacks, parking setbacks, <br />re iced # of parking stalls, floor area ratios, building height, off-street loading/unloading <br />re irements, lighting, landscaping and signage and found the proposed site plan to fully <br />co ply with all requirements of Section 6-150 and Chapter 11 of the Zoning Code. <br />11. A itionally, the Planning Commission and City Council find the performance standards <br />re fired under Section 6-390 are met. <br />Now TREFO1tE BE IT RESOLVED, that based upon the above findings of fact the application for <br />a Site {+~Ilan (LP2007-004) is hereby approved, subject to the following condition: <br />Development\4-24-2007U.P2007-004 (New Brighton Commons) - RESOLUTION.doc 1 <br />
