RESOLUTION NO. <br />07-035 <br />STATE OF MINNESOTA <br />COUNTY OF RAIVISEY <br />CITY OF NEW BRIGHTON <br />RESOL <br />MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN, PLANNED UNIT <br />AND SPECIAL USE PERMIT. <br />THERE , an application has been made by APi Group, Inc. to consider a Site Plan, Planned Unit <br />Develo ment, and Special Use Permit to allow construction of a corporate headquarters for APi <br />Group, c., a secondary multi-tenant office building, and associated joint-use surface parking. <br />THERE ,the procedural history of the application is as follows: <br />1. A lications for a Site Plan Review, Planned Unit Development, and Special Use Permit <br />we received on March 30, 2007. <br />2. Th Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on pril 17, 2007 and all present were given a chance to freely speak at the hearing. <br />3. Th Planning Commission considered the request and recamrnended approval to the City <br />4. Th~ City Council considered the request on April 24, 2007. <br />JHERE ,the Planning Commission and City Council make the following Findings of Fact with <br />respect o PUD2007-003, LP2007-006 and SP2407-003: <br />1. Th property is currently vacant, owned by the City, and intended for redevelopment in <br />acc dance with the Northwest Quadrant Framework Plan and Design Guidelines. <br />2. Th roperty is zoned MX, Mixed Use. <br />3. Th roperty is guided in the Comprehensive Plan for City Centex. <br />4. Th roperty is legally described as follows: <br />Lo ,Block 2, LONG LAKE LANDING, and <br />Lo ,Block 2, LONG LAKE LANDING <br />5. Th otal property area is approximately 3.979 acres. <br />6. Th Planning Commission. recommends approval for a Site Plan review in accordance with <br />Zo ng Ordinance Section $-010, subject to conditions. <br />7. Th City Council concurs with the Planning Commission's recommended conditions related <br />to a Site Plan and hereby approve the Site Plan in accordance with Section $-010. <br />8. Th Pluuung Commission considered the fallowing factors with regard to the application for <br />a P ed Unit Development: <br />The consistency of the proposed development with the adopted or proposed <br />comprehensive plan for the City. <br />The extent to which the proposed development is designed to form a desirable and <br />unified environment within its own boundaries in terms of relationship of structures, <br />patterns of circulation, visual character, and sufficiency of drainage and utilities. <br />The extent to which the proposed uses will be compatible with present and planned <br />uses in the surrounding area. <br />That the design of the development justifies any exceptions to the standard <br />Development\4-24-2007\PUD2007-003, LP2007-006,SP2007-003 (A.Pi Gxoup) - RESOLUTION.doc <br />1 <br />
