Dir. <br /> David Black, Assistant Community Development Director <br /> <br /> <br />? <br /> Minute Approval - <br /> May 21, 2002 <br />? <br /> Agenda Review – <br />No additions <br />? <br /> Council Action - <br /> Council Member Kim Moore-Sykes could not <br />be present. <br /> <br />Public Hearing: Special Use Permit for a new garage. Nonconforming Use Permit <br />for Type IV Nonconformities – Mark Ziniel <br />th <br />Application to consider a request by Mr. Mark Ziniel at 715 4 Avenue NW. The site is <br />zoned R-1A, Single Family Residential. The driveway is unpaved and the existing home <br />encroaches 3 feet into the front yard setback and 2.5 feet into the side yard setback. <br />When a resident proposes a new structure on a lot with Type IV nonconformities, a Type <br />IV Nonconforming Use Permit is required. Section 4-530 (E) states that any accessory <br />structure may be constructed up to a maximum of 1,000 square feet; any structure larger <br />than 400 square feet is subject to approval of a Special Use Permit. Mr. Ziniel is seeking <br />a Special Use Permit for his proposed 24 ‘ by 28’ garage (672 sq. ft.). <br /> <br />Mr. Boylan reviewed the findings for the Commissioners. Mr. Ziniel answered questions <br />by the Commissioners. No one from the audience spoke to the issue. Mr. Boylan <br />reported he had received no calls, letters or faxes from anyone. <br /> <br />CLOSE THE PUBLIC HEARING. <br />Moved and seconded to <br />5 Ayes, 0 Nays, Motion Carried. <br /> <br />WAIVE THE READING AND ADOPT THE <br />Motion by Zisla second by Baker to <br />RESOLUTION RECOMMENDING APPROVAL OF NC 02-003 AND SP 02-003 <br />subject to the following conditions: <br /> <br />1.The garage is sided with same or similar materials. <br /> <br />2.The driveway is completed within one year. <br /> <br />3.The retaining wall on public right of way will be altered or not depending <br /> <br />on City Engineer’s recommendation. <br /> <br /> <br />
