WAIVE THE READING AND ADOPT <br />Motion by O’Keefe, Second by Schoph to <br />THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF SP 02– <br />010. <br />6 Ayes, 0 Nays, Motion Carried. <br /> <br />Public Hearing: SP 02-009 Special Use Permit for a proposed detached garage <br /> <br />larger than 400 sq. ft. – James Hillyard. <br />Consideration of a Special use Permit to construct a garage larger than 400 sq. ft. on a <br />single family lot at 1830 Long Lake Road. The site is zoned R-1, Single Family <br />Residential. The garage proposed is a 22’ by 30 ‘ detached garage (660 sq. ft.). <br /> <br />CLOSE THE PUBLIC HEARING. <br />Motion by Baker, Second by O’Brien to <br />6 Ayes, 0 Nays, Motion Carried. <br /> <br />WAIVE THE READING AND ADOPT THE <br />Motion by Baker, Second by Zisla to <br />ATTACHED RESOLUTION RECOMMENDING APPROVAL OF SP 02-009 <br /> <br />6 Ayes, 0 Nays, Motion Carried. <br /> <br />Public Hearing: NC02-004, LP02-011 Nonconforming Use Permit & Site Plan <br />Phillip Johnson, Architect on behalf of Cement Masons, Plasterers and Shophands <br />JATC, Local 633. <br />Consideration of a request to construct an addition onto the existing building. The <br />parking area does not have curb and gutter on the east side and encroaches into the front <br />yard setback. The Code identifies this as a Type 4 Nonconforming Use, which requires a <br />public hearing. <br /> <br />Mr. Boylan reviewed the plans and noted that the applicant proposes to reduce the <br />nonconformities by removing the parking in this area and landscaping, but leave the area <br />because of ponding and flooding concerns. The proposal, including the site plan, and the <br />elevations show a building design, consistent with the existing structure. The Type 4 <br />nonconformities would be reduced. <br /> <br />No one from the audience chose to address the Commissioners on this issue. <br /> <br />CLOSE THE PUBLIC HEARING. <br />Motion by Baker, Second by O’Brien to <br />6 Ayes, 0 Nays, Motion Carried. <br /> <br />WAIVE THE READING AND ADOPT THE <br />Motion by Baker, Second by Schoph ,to <br />ATTACHED RESOLUTION RECOMMENDING APPROVAL OF THE <br />NONCONFORMING USE PERMIT AND SITE PLAN NC-02-004 and LP02-011 <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br /> <br /> <br />1.Approval OF a permit by the Rice Creek Watershed District. <br /> <br />2.The final grading plan shall be subject to review and approval of the City <br />Engineer. <br /> <br />3.The proposed trees near the street easement are replaced with one (1) 3” green <br />ash and centered in the landscaped area to improve visual ability for egress. <br /> <br />6 Ayes, 0 Nays, Motion Carried. <br /> <br />2 <br /> <br />
