The property encompasses an existing garage building at
558 Old Highway 8 and the adjacent vacant lot, known as 550 Old Highway 8, that is
used for parking to the north. The applicant is requesting a special use permit to allow
the existing automotive repair use to continue. Since November/December of 2005 the
applicant has been actively seeking to lease the property, which has produced inquires
with regard to ability to continue the automotive repair shop.

Baker inquired if the lot to the south of the building was also used by the applicant.
Gundlach replied that the south lot is not in common ownership and is not part of this
application. Howard asked who the public hearing notice went out to. Gundlach
reported that notices were sent to all properties within 350 feet of the applicant’s
properties.

Mark Jacobson, son of Sally Walfoort (applicant), approached the commission to answer
questions. Schiferl inquired if the building is on the property line. Jacobson answered
that when he received the photos from the City, he was told that the angle that the
satellite took the photos transposed the shadow line and thus the lines are not accurately
placed on the photo. Gundlach replied that Jacobson is correct, the lines depicted on the
photo are not the legal property lines and the photo is an aerial photograph.

I:\COMMISSIONS\PLANNING\Minutes\2006\02-21-06 minutes.doc
