<br /> Approved <br />know of any city ordinances that state a specific location for the bins to be placed. <br />Schiferl asked staff if there are any ordinances that regulated the appearance and up keep <br />of a business. Fernelius replied that there are provisions within the Nuisance code that <br />could be used, which is not part of the zoning code, but is part of the city code. He added <br />that between the two codes, these issues would be addressed and that since the property <br />owner has no problem with the solutions to these issues to put them down as conditions <br />of recommendation to ensure further compliance. Baker asked staff where they would <br />put these recommendations. Gundlach replied that number five could be changed from <br />“satisfied” to “subject to the following conditions” with the conditions following. <br />Schiferl suggested the following conditions: outside repair of vehicles is prohibited, <br />outside storage of parts or tires is prohibited and over night parking and/or storage of <br />vehicles in excess of 72 hours is prohibited. O’Keefe suggested that a vehicle may sit <br />outside for over 72 hours if it is waiting on parts. Jacobson recommended that the <br />Commission add a provision that vehicles stored outside have an open repair ticket to <br />help eliminate storage problems. Howard questioned what or who would regulate the <br />length of time that a vehicle could sit with an open repair ticket. Jacobson stated that <br />putting a time line on vehicles with open tickets could be hard on the in coming tenant <br />and that customers are bringing their cars in to be fixed and not to be abandoned. <br /> <br />th <br />Orv Kraus, 2001 28 Avenue NW, representing the Eagles, approached the Commission <br />to state that this property has never been a problem and would recommend that no further <br />regulations be placed on the property. Schiferl asked if the Commission would like to <br />address the landscaping and curbing issues or if they would like to have the nuisance <br />ordinance handle it. Zisla replied that the nuisance ordinance should handle it. <br /> <br />Motion by Baker, second by O’Keefe to <br />WAIVE THE READING AND ADOPT THE ATTACHED <br /> <br />SP 06-02 <br /> subject to the following <br />RECOMMENDING APPROVAL <br />OF <br />RESOLUTION <br /> <br />conditions: <br />A.
