Howard asked that a boarder search be done to see if there is any other city that <br />has addressed this issue. <br /> <br /> <br /> <br />CONTINUE THE PUBLIC HEARING MEETING to <br />Motion by Baker, Second by Schiferl to <br />ALLOW ADDITIONAL STAFF RESEARCH. <br /> <br />MOTION CARRIED. <br />7 Ayes, 0 Nays, <br /> <br /> <br /> <br />Public Hearing: <br />SP2006-008, VN2006-001, LP2006-003 Site Plan Review including <br /> <br />Special Use Permits for Automotive Repair, Automotive Sales, Building Setback <br />Variance, and a Parking Variance <br /> <br />The applicant is proposing construction of a 27’ x 60’ building (1,620 s.f.) with four <br />overhead doors and associated off-street parking to conduct an automotive repair shop. <br />The proposal requires a Site Plan Review in order to develop an existing vacant parcel <br />within the I-1, Light Industrial District, a Special Use Permit to operate an automotive <br />repair business, a Special Use Permit to permit automotive sales (and obtain a state- <br />issued dealers license), a variance to the required southerly building setback, and lastly a <br />variance to the required number of off-street parking stalls. <br /> <br />This applicant appeared before the Planning Commission and City Council in October of <br />2003 and gained approval of a similar request. The applicant never obtained a building <br />permit in accordance with Zoning Ordinance Section 8-040 and the approvals have <br />expired. This request differs from the 2003 approval in that the building is somewhat <br />larger in footprint but single story, the parking layout has been altered to accommodate <br />the larger building footprint, a greater southerly building setback variance is proposed, <br />and a Special Use Permit for automotive sales has been added. <br /> <br />The applicants approached the commission and explained the reason why they need the <br />car dealer special use permit. They would like to sell salvaged cars and need the parking <br />spaces to be able to get a salvage car dealer license. They don’t intend to sell the cars in <br />that lot. Schiferl inquired who would come for the auto sales. They stated that they <br />would be able to sell cars on line that have been repaired, but the owner is not able to <br />pay. Mann asked what would regulate them, if they received a dealer’s license and a car <br />sale Special Use Permit, from opening up a sales lot in their parking lot. Gundlach <br />replied that the state requirements that the applicants would need to get for their dealers <br />license are very broad and the City would have to sign off on that permit.
