Approved Motion by Baker, Second by Schiferl to Motion to waive the reading and adopt the recommending approval SP2006-011 with the following attached resolution of changes and subject to the following conditions : 1.The applicant may hold one sale event in the spring and one sale event in the fall per calendar year, 2.The date of the vehicle sale events must be submitted and approved by City Staff at least 90 days in advance of the event and must be held on a Saturday or Sunday, 3.The sales may only be conducted between the hours of 8:00am and 4:30pm, 4.No more than 175 vehicles may be displayed for sale, 5.Vehicles for sale must be removed from the property no later than 6:30pm on the day of the sale, 6.The Director of Public Safety shall review and approve of each sale event and any traffic safety measure deemed necessary by the Director shall be implemented, and 7.If at any time the vehicle sale event creates a Public Safety concern and/or the conditions of this Special Use Permit cannot be met, the City Planner will require reconsideration of the Special Use Permit by notification to the applicant and by holding a public hearing with the Planning Commission. Public Hearings: ZA2006-007 Zoning Code Amendment Related to Fence Construction on Lots Abutting a DNR-Classified Lake At the direction of the City Council, a Zoning Code amendment has been proposed that would restrict fence construction within the lake yard of properties abutting a water body. The intention of the ordinance amendment would be to preserve lake views for lakeshore property owners. In an effort to gain as much feedback from affected property owners, the City notified all property owners who abut a DNR-classified lake, which includes Long Lake, Rush Lake, Pike Lake, Jones Lake, and Poplar Lake. The notice was mailed to 225 property owners. This amendment would only apply to fences erected on residentially zoned property. The amendment proposes establishment of an “average lakeshore setback” and prohibits construction of a fence within this setback area. The average lakeshore setback is defined as the average distance from the shoreline of existing principal residence buildings on adjacent lots.
