<br />Approved <br />located at 2023 Old Highway 8 NW and is proposing, as part of the plat, to combine it <br />with existing property to be used for future surface parking, if needed. <br /> <br />The preliminary and final plat will run together whereby three properties will be <br />combined on one lot and one block to be known as the Niedernhoefer Addition. Lastly, <br />the plat as proposed includes road property that will be acquired as part of a right-of-way <br />vacation of Mound Avenue. This would be a partial Vacation, considered as a separate <br />item, whereby the City would retain the ability to keep utilities in this location but would <br />vacate the right-of-way for public purpose. Procedurally, approval of this proposal would <br />include the condition that the right-of-way vacation is approved. <br /> <br />O’Brien inquired to why staff is requesting a one year maximum on the removal of the <br />house and not the two years that was requested. Gundlach replied that under similar <br />circumstances the City typically requires a one year removal and a letter of credit, but the <br />Commission could suggest a different time line. O’Keefe asked if it applies to all the <br />structures on the lot. Gundlach replied that it does apply all the structures on the lot. <br /> <br />Zisla inquired to why this property is subjected to a park dedication fee since it is a <br />redevelopment. He added that he would like to know if there is a formula that will decide <br />how much the cash amount would be versus a 10 percent land dedication, and what are <br />the criteria for the formula that the Council will use to determine the amounts. <br /> <br />Gundlach replied that the park dedication ordinance states that it does apply to re- <br />divisions that facilitate a redevelopment. She added that a formula in relation to a cash <br />amount is not in the ordinance; however that ordinance does state that the Council has the <br />discretion to increase or decrease the dedication depending upon its intended use. If the <br />Council decides that this development will have little impact on our park system, then <br />they could reduce the dedication. <br /> <br />Mann stated that she understands that no new employees are being added and citizens <br />would not be going to enjoy a park in that general area, the Council can keep those items <br />in mind when considering the development’s park dedication fee. Gundlach stated that is <br />how she understands the ordinance; however there is not a specific formula to be used. <br /> <br />Zisla inquired if there is a formal process where by the amount can be reduced. <br />Gundlach replied that this is the first time the park dedication fee will be applied to a <br />commercial development, so the Council will need to decide what sort of process they <br />would like to implement. <br /> <br />Zisla asked if Commissioner Mann’s statement is true that they would not be adding any <br />employees. Gundlach replied that it is her understanding that they will not be adding <br />employees to the addition. Norm Wells, architect for this development, stated that <br />Cheetah Precision would not be adding any employees. This addition is to attach the two <br />existing buildings so, the current employees do not have to traverse outside during <br />inclimate weather, and to increase the amount of work space.
