<br /> <br /> <br /> <br /> <br /> RESOLUTION NO. <br /> 07-043 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> <br /> RESOLD N MAKING FINDINGS OF FACT AND APPROVAL OF A PARTIAL RIGHT-OF-WAY <br /> VACATION. <br /> WHEREAS, an application has been made by the City of New Brighton, in cooperation with Norm <br /> Wells d Manfred Niedernhoefer, for a partial right-of-way Vacation of Mounds Avenue, that <br /> portion f which intersects at Old Highway 8 NW. <br /> WHEREAS. the procedural history of the application is as follows: <br /> 1. ublic hearing notices for the right-of-way vacation were published in the New Brighton <br /> ulletin on February 7, 2007. <br /> 2. ublic hearing notification was distributed to all property owners within 350' of the <br /> bject property. <br /> 3. he Planning Commission, pursuant to published and mailed notices, held on a public <br /> Baring on February 20, 2007. <br /> 4. he Planning Commission recommended conditional approval to the City Council for the <br /> artial right-of-way vacation on February 20, 2007. <br /> 5. he City Council reviewed the request on April 10, 2007 and tabled action. <br /> 6. he City Council continued discussion on May 8, 2007 and approved the request subject <br /> conditions. <br /> <br /> WHEREAS, the Planning Commission and Council make the following Findings of Fact with <br /> respec o VA2007-001: <br /> 1. he eastern approximately 165' of Mounds Avenue was vacated previously per <br /> ocument 42837905. <br /> 2. e City will retain its right to keep and maintain existing water and sanitary sewer <br /> tilities. <br /> 3. he public roadway provides access to two different owners: Cheetah Precision, 2023 <br /> ld Highway 8 NW/52 Mounds Avenue/55 Mounds Avenue, and an office user at 2044 <br /> ld Highway 8 NW. <br /> 4. he property at 2044 Old Highway 8 NW has frontage along Old Highway 8 NW. <br /> 5. heetah Precision and 2044 Old Highway 8 NW have agreed to enter into a Shared <br /> ccess Agreement. <br /> 6. heetah Precision has made a separate application to re-plat 2023 Old Highway 8 NW, <br /> 2 Mounds Avenue, and 55 Mounds Avenue into one lot on one block, to be known as <br /> IEDERNHOEFER ADDITION. <br /> 7. he Planning Commission held a public hearing on the partial right-of-way vacation on <br /> February 20, 2007 and all persons were given the opportunity to be heard. <br /> 8. he Council considered the request on April 10, 2007 and May 8, 2007. <br /> <br /> <br /> I:\COUNI~ L\REPORTS\2007\Community Development\5-8-07WA2007-001 (City & Cheetah Precision) - RESOLUTION.doc 1
