G. Rud & Sons Inc. on <br /> behalf of the City on March 30, 2007. <br /> 2.' i Public hearing notices for the Preliminary and Final Plat were published in the New <br /> Brighton Bulletin on April 4, 2007. <br /> 3.~ Public hearing notification was distributed to all property owners within. 600' of the <br /> subject property. <br /> 4.1 The Planning Commission, pursuant to published and mailed notices, held on a public <br /> <br /> I bearing on April 17, 2007. <br /> 5. The Planning Commission recommended approval to the City Council for the <br /> a I Preliminary and Final Plat on April 17, 2007. <br /> a <br /> 6. The City Council considered the request on April 24, 2007. ` <br /> <br /> WHERI y s, the Planning Commission and City Council make the following Findings of Fact with <br /> respe¢ to the Preliminary Plat (PL2007-003) and Final Plat (FP2007-003): <br /> The property is zoned R-3A, Multi-Family Residential. <br /> The property is located in the area known at Tract 1 of the Northwest Quadrant, <br /> I , exclusively on the west side of Old Highway 8 NW, and is legally on sheets 1 & 2 <br /> of 6 of Exhibit A. <br /> i <br /> The Planning Commission held a public hearing on the preliminary and final plat on I <br /> April 17, 2007 and all persons were given the opportunity to be heard. <br /> Section 26-33 of the City Code provides the following qualifications governing <br /> approval of a preliminary plat: 9 <br /> A. The Planning Commission may return a conditional recommendation. The City <br /> Council may require revisions as it deems necessary for the health, safety, <br /> I general welfare, order and convenience of the City. <br /> I3. The approval of a preliminary plat indicates that the subdivider may proceed <br /> toward fulfilling the necessary steps for approval of the final plat in accordance <br /> with the tenor of approval. <br /> C.
