<br /> <br /> <br /> <br /> <br /> RESOLUTION No. 07-069 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEw BRIGHTON <br /> RESOLU ON MAKING FINDINGS OF FACT ANU APPROVAL OF AN AMENDMENT TO PLANNED UNIT <br /> DEVELOPMENT 2007-003, DOCUMENTED UNDER RESOLUTION # 07-035. <br /> WHERE, k , an application has been made by Finn Daniels Architects on behalf of API Group, Inc. <br /> to be considered for an amendment to a previously approved Planned Unit Development <br /> allowing for increased building square footages. <br /> WIIERE , the procedural history of the application is as follows: <br /> I . Th City Council approved PUD2007-003 on April 26, 2007. <br /> 2. An pplication for a Planned Unit Development Amendment was received on June 1, 2007. <br /> 3. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br /> on June 19, 2007 and all present were given a chance to freely speak at the hearing. <br /> 4. The City Council considered the request on June 25, 2007. <br /> WHERE , the Planning Commission and City Council make the following Findings of Fact with <br /> respect o PUD2007-004: <br /> 1. PU 2007-003 was previously approved in Resolution #07-035 and outlines how AN Group, <br /> Inc proposes to develop the site and comply with the PUD standards noted in Section 7-240. <br /> 2. The proposed amendment to increase total building square footage by 3,626 s.f. does not <br /> ne tively impact compliance with Section 7-240. <br /> 3. Th proposed amendment to increase to building square footage by 3,626 s.f. does not impact <br /> an they component of the site plan or previous approval. <br /> 4. The increase in square footage amounts to common areas, such as the lobby, exercise room, <br /> bre rooms, etc. and does not increase the number of people expected by be employed on <br /> the ite immediately or at full build-out. <br /> 5. W ' e no additional parking stalls have been provided, the applicant has effectively <br /> de nstrated that no additional parking stalls should be required. <br /> <br /> Now TI REFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Planned Unit Development Amendment (PU2007-004) is hereby approved subject to continued <br /> compli ce with Resolution #07-035. <br /> Adopt this 25`I' day of June, 2007. <br /> Steve Larson, Mayor <br /> <br /> <br /> <br /> A I"T) - Dean R.
