<br /> <br /> <br /> <br /> <br /> RESOLUTION NO. 07-070 <br /> I STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEw BRIGHTON <br /> <br /> RESOLD ION MAKING FINDINGS OF FACT AND APPROVAL OF AN AMENDMENT TO PLANNED UNIT <br /> DEVE PMENT 2006-002, DOCUMENTED UNDER RESOLUTION # 06-085. <br /> WHERE , an application has been made by David Bernard and Sherman Associates to be <br /> consid red for an amendment to a previously approved Planned Unit Development allowing for <br /> Site P1 modifications. <br /> WHERE , the procedural history of the application is as follows: <br /> 1. The City Council approved PUD2006-002 on August 22, 2006. <br /> 2. A pplication for a Planned Unit Development Amendment was received on June 1, 2007. <br /> 3. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br /> on ne 19, 2007 and all present were given a chance to freely speak at the hearing. <br /> 4. Th City Council considered the request on June 25, 2007 <br /> WHERE , the Planning Commission and City Council make the following Findings of fact with <br /> respec o PUD2007-005: <br /> 1. P 2006-002 was previously approved in Resolution #06-085 and outlined development of <br /> the site and all conditions necessary in order to comply with the PUD standards noted in <br /> Se ion 7-240. <br /> 2. The proposed amendment, which reduces the units provided from 674 to 519, does not <br /> ne tively impact compliance with Section 7-240 or any R-3A standards. <br /> 3. Th proposed Site Plan modifications continue to meet the spirit and intent of the Northwest <br /> Q drant Framework Plan and Design Guidelines that were adopted in December of 2005. <br /> 4. Th proposed amendment does not impact any other component of the previously approved <br /> P , as the building types, unit mix, landscaping/lighting, signage, and provided parking <br /> re in unchanged. <br /> Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Planned Unit Development Amendment (PU2007-005) is hereby approved subject to the <br /> follow g: <br /> 1. Th site is developed in accordance with attached Exhibit A. <br /> 2. C pliance with Resolution 06-085. <br /> 3. A UD amendment must be processed for Tract 2 prior to issuance of building permits for <br /> Tr, t 2. <br /> 4.
