_4 <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 07-077 <br />Minn <br />~ RESOLUTION AUTHORIZING APPROVAL AND EXECUTION OF A <br />tELOGATION AGREEMENT BY AND BETWEEN THE CITY OF NEW <br />3RIGHTON, MINNESOTA AND THE UNITED STATES POSTAL SERVICE <br />~OR THE RELOCATION OF ITS POST OFFICE AT 1255 OLD HIGHWAY <br />I N.W. <br />E IT RESOLVED by the City Council (the "Council") of the City of New Brighton, <br />eta (the "City") as follows: <br />n 1. Recitals. <br />11.01 The City has been working far many months with the United States Postal <br />Servi~~ (the "USPS") to facilitate its relocation from its existing site at 1255 Old Highway S <br />N.W. new sites being developed within the City. <br />X1.02 On or about June 6, 2006, the City filed an eminent domain petition to secure <br />legal i~le to and possession of the USPS's existing site. <br />1.03 On August 8, 2006, the Council by Resolution No. 06-071 approved a Letter <br />of Un rstanding with the USPS providing for payment by the City of relocation costs and <br />rent d erential payments, and also authorized negotiation of a Relocation Agreement to be <br />prese ted to Council for its approval. <br />1.04 On May 14, 2007, the City took title to the site pursuant to an Order and <br />Recei t of Deposit of the Court in the eminent domain proceeding. <br />' 1.05 A Relocation Agreement in the farm attached hereto has been negotiated by <br />the C Manager and City staff with the USPS and is being presented to Council for its <br />appro al. <br />ion 2. Findings. <br />.01 The Council hereby finds that the proposed Relocation Agreement promotes <br />the o ectives outlined in its Restated Development Program established pursuant to <br />Minn ota Statutes, Sections 469.124 to 469.134, as amended. <br />
