RESOLUTION N0.07-090 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />UTION MAKING FINDING OF FACT AND APPROVAL OF A MINOR SUBDIVISION. <br />?As, an application has been made by the City of New Brighton to permit the <br />vision of three parcels from 50 14th Street NW to facilitate the reconstruction of a <br />)n of old Highway 8 NW, and <br />TI JREAS, the procedural history of the application is as follows: <br />Li ? The City retained E.G. Rud & Sons, Inc. to prepare a Certificate of Survey including <br />the legal descriptions of the parcels to be acquired, with said survey completed on <br />I March 6, 2007. <br />2.1 A public hearing notice was published in the August 1, 2007 edition of the New <br />Brighton Bulletin. <br />3j The City Council held a public hearing on August 14, 2007, where all parties present <br />11 were given the opportunity to speak. <br />The City Council voted on August 14, 2007 to approve the request. <br />2. <br />3. <br />PEAS, the City Council makes the following Finds of Fact with regard to the Minor <br />division (MS2007-002): <br />The property is located at 50 14'h Street NW. <br />The property is zoned MX, Mixed Use. <br />The property is guided in the New Brighton Comprehensive Plan for City Center. <br />Three (3) parcels are proposed to be subdivided off from the property located at 50 <br />14th Street NW, which is legally described as follows: <br />That part of the Southeast Quarter of the Northeast Quarter of Section 20, Township <br />30, North, Range 23.West, lying southeast of Old State Trunk Highway 8-63 and <br />northeast of the Minnesota Transfer Railway Company's Butcher Spur Right-of-Way, <br />except the north 450 feet and further excepting the following: Beginning at the point <br />of intersection of the southeasterly line of Old State Trunk Highway 8-63 and the <br />northeasterly line of Butchers Spur Right-of-Way; thence northeasterly along the <br />southeasterly line of Old State Trunk Highway 8-63 a distance of 220 feet; thence <br />deflect 90 degrees to the right a distance of 185 feet; thence deflect 90 degrees to the <br />right and thence southwesterly on said deflection to the north line of 14th Street <br />North; thence west on the north line of said 14th Street North to the northeasterly line <br />of Butchers Spur Right-of-Way; thence northwesterly on the northeasterly line of said <br />Butchers Spur Right-of-Way to place of beginning; subject to streets. <br />The three (3) parcels included in the Minor Subdivision are necessary in order to <br />reconstruct a portion of Old Highway 8 NW. <br />The total property area included for minor subdivision is 21,778 s.f. or 0.49 acres.
