(r Report Number: 777 - Z <br />EW <br />IV Agenda Section: <br />BMGHTON Report Date 8/22/2007 <br />- <br />the city that works for you Council Meeting Date 8/28/2007 <br />0 REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: Adoption of a revised Ordinance No. 744, originally adopted on August 22, 2( <br />reflecting corrected legal descriptions of the recorded plat of LONG LAKE LANDING. <br />DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this report Comments attached <br />Recommendation: Adopt the attached 0fdmance revising the legal descriptions noted in originally <br />adopted Ordinance No. 744. <br />Legislative History: January 31, 2006: The Planning Commission held a public hearing concerning a <br />rezoning request within the Northwest Quadrant, rezoning property from MX, Mixed Use to R-3A, <br />Multi-Family Residential, and voted unanimously to approve. <br />August 22, 2006: The City Council adopted Ordinance No.744 rezoning certain property within the <br />Northwest Quadrant, located on the west side of Old Highway 8 NW, from MX, Mixed Use to R-3A, <br />Multi-Family Residential. <br />0 Financial Impact. None <br />Explanation: The Planning Commission and City Council approved a City-initiated rezoning request <br />for property within the Northwest Quadrant in 2006. This rezoning request was to facilitate the "bract I <br />housing development on the west side of Old Highway 8 NW. The Planning Commission held a public <br />hearing in January of 2006, however the Council didn't approve the rezoning until August. This delay <br />was to allow the housing developers time prepare their plat, with the rezoning ordinance noting those <br />legal descriptions. However, that plat was never recorded and as such the legal descriptions do not <br />match the property that was intended for rezoning. <br />'T'hen, in April of 2007 the Council approved a plat, also named LONG LAKE LANDING. This plat <br />was prepared by the City and essentially took the place of the plat the housing developers prepared, but <br />never recorded. The revised ordinance attached to the memo merely states the corrected legal <br />descriptions based upon the recorded plat. <br />Lastly, the Council is being asked to consider a rezoning request to NWQ, Northwest Quadrant District <br />at the meeting on August 28, 2007. The rezoning request includes the property impacted under this <br />revised Ordinance No. 744. Staff feels for record keeping purposes it is important this Ordinance No. <br />744 is amended. <br />Costs and Funding: None <br />Janice Gundlach <br />City Planner
