RESOLUTION NO. 07-102 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON ION MAKING FINDING OF FACT AND APPROVAL OF A MINOR SUBDIVISION. 'H AS, an application has been made by the City of New Brighton to permit the su ivision of three new parcels for property located at 400 1st Street SW to facilitate a rai oad project. Y 'H AS, the procedural history of the application is as follows: 1. ''A public hearing notice was published in the August 15, 2007 edition of the New I Brighton Bulletin. 2.1 The City Council held a public hearing on August 28, 2007, where all parties present were given the opportunity to speak. 3. The City Council voted on August 28, 2007 to table the request pending the drafting of legal descriptions for the proposed subdivision. 4. The City Council again considered the request on September 11, 2007 and voted to approve the minor subdivision. 2 3 6i REAS, the City Council makes the following Finds of Fact with regard to the Minor )division (MS2007-004): The property proposed for subdivision is located at 400 1st Street SW. The existing property consists of four base parcels with property identification numbers of 32-30-23-12-0002, 323023120013, 323023110010, and 32-30-23-11- 0012. The total property area consists of approximately 353,989 s.f. or 8.13 acres. The property is zoned 1-2, Heavy Industrial District. The property is guided in the New Brighton Comprehensive Plan for Heavy Industrial. The subdivision is necessary to facilitate a railroad project and does not in and of itself establish any new buildable lots for development. The existing property is legally described as follows: (Torrens Certificate No. 504064) That part of the Northwest quarter of the Northeast Quarter of Section 32, Township 30, Range 23, lying Northerly of the center line of First Street Southwest, and lying Easterly of the Minnesota Transfer Railway Company right of way and Southerly of the Minneapolis, St. Paul Pacific and Sault Ste Marie right of way, subject to the rights of public in and to First Street Southwest.
