RESOLUTION No. 07-095 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLT?'?ION MAKING FINDINGS OF FACT AND APPROVING OF A SPECIAL USE PERMIT AND <br />NONC kFORMING USE PERMIT. <br />?HEREMS, an application has been made by Bill and Maria Lloyd to permit construction of an <br />additi 6 to the existing attached garage whereby the total square footage would exceed 624 s.f. at <br />1901 1?yhigh Drive, and <br />'HERENS, the procedural history of the application is as follows: <br />1. Axe pplication for a Special Use Permit was received on August 2, 2007. <br />2. Fol owing submission of the Certificate of Survey it was determined by staff that a <br />N conforming Use Permit would also be necessary. <br />3. Tl Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on , ugust 21, 2007 and all present were given a chance to freely speak at the hearing. <br />4. T Planning Commission recommended approval on August 21, 2007 subject to conditions. <br />5. T City Council considered the request on August 28, 2007. <br />THERE s, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (SP2007-010) and Nonconforming Use Permit (NC2007-003): <br />1. T property is zoned R-1, Single Family Residential. <br />2. T property is guided in the Comprehensive Plan for Low Density Residential. <br />3. T 4 property is legally described as follows: <br />I Lot 7, Block 3, VALLEY VIEW PARK <br />4. T applicant has proposed to construct an addition to the existing attached garage whereby <br />th total square footage would exceed 624 square feet at 805 square feet. <br />5. Tl Planning Commission and Council considered the proposal in accordance with Zoning <br />C( P1 e Section 4-530 (1) (E) which requires approval of a Special Use Permit for any <br />ac ssory building in excess of 624 square feet. <br />6. T Planning Commission and Council considered the proposed Special Use Permit in <br />ac rdance with Zoning Code Section 4-530 (1) (K) which requires that the detached garage <br />m t the following conditions: <br />a. gi and exterior color and material must be consistent and complimentary with the <br />i iRoof <br />Drincinal structure, <br />b. 11f deemed necessary by the City Council, landscape screening shall be provided to lessen <br />Ivisual impact from adjacent properties. <br />c. ! 'No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />7. T ht Planning Commission and Council reviewed the proposal in accordance with the <br />fo owing Special Use Permit conditions of Zoning Code Section 8-130: <br />a. j That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />TS\2007\Community Development\8-28-2007\SP2007-010, NC2007-003 (Lloyd) - RESOLUTION.doe 1
