RESOLUTION • <br />PLANNING COMMISSION <br />CITY OF NEw BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A SITE PLAN, PLANNED UNIT <br />DEVELOPMENT AND PRELIMINARY AND FINAL PLAT. <br />WHEREAS, an application has been made by Ryan Companies for consideration of a Site Plan, <br />Planned Unit Development, and Preliminary and Final Plat in order to develop a 120,000 s.f. 2- <br />story office building located within the Northwest Quadrant, east side of Old Highway 8 NW, <br />currently addressed at 19 & 199 14`x' Street NW, including conceptual PUD approval of a second <br />phase. <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan, Planned Unit Development, and Preliminary and Final Plat <br />were submitted on August 2, 2007 <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on August 21, 2007 and all present were given a chance to freely speak at the <br />hearing. <br />3. The Planning Commission considered the request and recommended that the City <br />Council approve the proposal subject to conditions. <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the Site <br />Plan (LP2007-009), Planned Unit Development (PU2007-007), Preliminary Plat (PL2007-004) <br />and Final Plat (FP2007-004): <br />1. The property is located generally at 19 & 119 14th Street NW and is legally described on <br />attached Exhibit A. <br />2. The property is zoned NWQ, Northwest Quadrant District. <br />3. The property is guided in the Comprehensive Plan for City Center. <br />4. The total property area is approximately 6.56 acres. <br />5. The Planning Commission recommends approval for a Site Plan application in <br />accordance with Zoning Code Section 5-010, subject to conditions. <br />6. The Planning Commission considered the following factors with regard to the application <br />for a Planned Unit Development: <br />a. The consistency of the proposed development with the adopted or proposed <br />comprehensive plan for the City. <br />b. The extent to which the proposed development is designed to form a desirable and <br />unified environment within its own boundaries in terms of relationship of structures, <br />patterns of circulation, visual character, and sufficiency of drainage and utilities. <br />c. The extent to which the proposed uses will be compatible with present and planned <br />uses in the surrounding area. <br />d. That the design of the development justifies any exceptions to the standard <br />requirements of the Zoning Code. <br />e.
