Johnson, Building & Planning Coordinator <br />RE: License Revisions -The Mengelkoch Co. and Gordon Rendering Co. <br />The Council directed that we prepare comments on the proposed <br />revisions to The Offensive Trade License. This memo responds <br />to that directive and also discusses suggestions and changes to <br />the resolution regarding Gordon Rendering Co. <br />The suggested changes to the resolution regarding The <br />Mengelkoch Co. are: <br />1. The 4th Whereas was changed to say that the tests were <br />found unsatisfactory rather than that they were rejected. <br />This change was directed by the Council. <br />2. Delete the 5th Whereas - Both companies were concerned <br />about this section because they felt it continued to <br />indict them for past problems that have been corrected. <br />We have worded this as much as possible to indicate that <br />these were conditions in the past and not necessarily <br />present problems. We feel the paragraph should stay in, <br />however, since it, like all the Whereas clauses, described <br />the background that has led to imposition of the conditions <br />listed in the resolution. Without that background, there <br />is no clue as to why the various conditions were imposed. <br />3. Delete the words "health and safety" from the 6th Whereas - <br />The City's police powers are founded in the need, among <br />others, to protect the public health and safety. We have <br />received complaints about the odors and vomiting induced by <br />the odors has been mentioned. Health and safety effects seem <br />to be present. <br />4. Revise item #1 to require closing of doors during hours of <br />operation has been done for both Offensive Trades Licenses. <br />This should not create a problem for enforcement and the <br />general conditions of the ordinance would still govern <br />any potential odor problem. This change was directed by <br />the Council. <br />
