Serendipity Court <br />New Brighton, Mn. 55112 <br />Registered Builder <br />612/631-1213 <br />TO: City Council <br />New Brighton, Minnesota <br />October 6, 1976 <br />The home at 80 32nd Avenue N1W or Lot 11, Block 1, SILVER MILLS was <br />staked and platted prior to digging at a side yard setback of 81. In <br />order to save a large tree on the south side of the lot, the excavation <br />was moved to the north. <br />Thinking the house was easily 5' from the north property line, the <br />side setback was not verified. Also, the piles of dirt from the excavation <br />made it very difficult to verify. <br />Only months later did we realize the house was only 3' from the north <br />line. The owner of the house demanded 5 additional feet but compromised <br />for 4 additional feet or a total of 71 from the north line. <br />Both owners are in agreement to the land split. The surveys will show <br />that each lot easily meet the 10,000 square foot and �5' wide building <br />site requirements for the R-1 zoning, after the land split. <br />I hereby respectfully request approval of a land split as shown on the <br />attached certificates of survey. <br />Sincerely yours, <br />David E.
