VWBROI(arrON <br />l <br />the city that works for you <br />Report Number: <br />Agenda Section: <br />Re ort Date November 6, 2007 <br />Council Meeting Date November 13, 2007 <br />REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: CONSIDERATION OF PARTIAL PAYMENT 5 AND CHANGE <br />ORDER NO. 3, FOR PROJECT 07-3, OLD HIGHWAY 8 NW RECONSTRUCTION <br />DEPARTMENT HEAD'S APPROVAL: <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this report / Comments attached <br />Recommendation: To approve contract Partial Payment 5 in the amount of $296,764.66 and Change <br />Order No. 3 which reduces the contract amount by $560.00 for Project 07-3, Old Highway 8 NW <br />Reconstruction to North Pine Aggregate, Inc. <br />Legislative History: Project 07-3 consists of the reconstruction of Old Highway 8 NW from I-694 to <br />the Long Lake Regional Park entrance. The City Council awarded a contract to North Pine Aggregate <br />on June 12, 2007. On July 10, 2007, the City Council approved Change Order No. 1 which added three <br />items to the contract that deal with a MnDOT storm sewer permit for working in the I-694 right-of-way. <br />Change Order No. 2, approved on October 9, added the removal and replacement of the guard rail on <br />the west side of Old Highway 8 NW immediately north of the I-694 bridge. <br />Financial Impact: Please see attached payment breakdown for details. <br />Explanation: Change Order No. 3 consists of replacing 16 of the 2-1/2 inch Autumn Blaze Maples <br />with a hardier 2 -inch Sienna Glen Maple. By changing to the Sienna Glen Maple which is a smaller <br />caliper tree results in a savings to the City. <br />The provisions of the contract with North Pine Aggregate, Inc. stipulate that the City makes a partial <br />payment to the contractor at least once each month at regular intervals on the basis of the work <br />performed during that preceding month. This partial payment shall not exceed 95 percent of the value <br />of the certified estimate. <br />Costs and Funding: The construction portion of this project is being funded from a combination of <br />funding sources including a Mn/DOT grant, EPA grants, Municipal State Aid funds, Ramsey County <br />Cooperative Agreement funds, City Utility funds, and TIF Bond proceeds as outlined in the Feasibility <br />Report. <br />4'J /� ///, <br />Grant M.
