<br /> <br /> <br /> <br /> <br /> <br /> • RESOLUTION NO. <br /> 06-029 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEw BRIGHTON <br /> <br /> RESOLUTI MAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT AND SITE PLAN <br /> REVIEW F SP2006-005 AND LP2006-001. <br /> <br /> WHEREAS, application has been made by Scott Gordon, of FW Gordon Construction., Inc. to be <br /> considere for a Special Use Permit and Site Plan Review. <br /> <br /> WHEREAS, te procedural history of the application is as follows: <br /> <br /> 1. Ai ~ application for a Special Use Permit and Site Plan review was approved by the City Council <br /> o pril 26, 2005 but was allowed to expire. <br /> 2. Planning Commission considered a request and held a public hearing on March 21, 2006 to <br /> re pprove the Special Use Permit and Site Plan Review. <br /> 3. TT. a Planning Commission recommended approval to the City Council for the Special Use <br /> P it and Site Plan Review on March 21, 2006. <br /> 4. T1 t City Council reviewed applications SP2006-005 and LP2006-001 on March 28, 2006. <br /> <br /> WHEREAS, he City Council makes the following Findings of Fact in respect to SP2006-005 and <br /> LP2006- l: <br /> 1. The property is zoned MX, Mixed Use. <br /> 2. The property is approximately 43,524 sq. ft. in area including the outlot to the north. <br /> 3. The Planning Commission recommended approval for a Site Plan Review. <br /> 4. The Planning Commission held a public hearing for a Special Use Permit to consider <br /> building height over 40 feet on March 21, 2006 and all persons were given the opportunity <br /> to be heard. <br /> 5. Buildings with proposed heights greater than 40 feet in the MX Zoning district are <br /> required to obtain a Special Use Permit and meet the standards found in Section 6-550: <br /> a. All buildings that are located on sites adjacent to Long Lake Regional Park <br /> shall take advantage of the views to Long Lake and shall provide site <br /> improvements that compliment the natural features of Long Lake Regional <br /> Park. <br /> b. All developments shall provide pedestrian linkages to Long Lake Regional <br /> Park and neighboring developments for residents, employees, and shoppers, <br /> and provide integrated parking and transit elements whenever practical. <br /> c. All uses shall be complementary or integrated and buildings shall be related or <br /> connected in accordance with the vision of the adopted Highway 8 Corridor <br /> Study. <br /> d. All buildings and building sites shall be designed to encourage social <br /> interchange and a sense of community, provide sufficient residential <br /> • amenities, and mitigate any adverse impacts of business and industrial uses on <br /> residential uses. <br />
