<br /> <br /> <br /> <br /> <br /> • RESOLUTION NO. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF A NONCONFORMING USE PERMIT. <br /> <br /> WHEREAS, an application has been made McMonigal Architects, on behalf of Robert and Jo <br /> Norell, to permit construction of an addition to the rear of the home and various other interior <br /> and exterior improvements, where the existing home is setback 26' from the front property line <br /> and 4' from the southern side lot line at 1842 Long Lake Road, and <br /> <br /> WHEREAS, the procedural history of the application is as follows: <br /> 1. An application for a Nonconforming Use Permit was received on November 7, 2007. <br /> 2. The Planning Commission, pursuant to a mailed notice to property owners within 350', held <br /> a public hearing on November 20, 2007 and all present were given a chance to freely speak at <br /> the hearing. <br /> <br /> 3. The Planning Commission considered the request on November 20, 2007, held a public <br /> hearing, and vote unanimously to approve. <br /> <br /> WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br /> respect to the Nonconforming Use Permit (NC2007-006): <br /> 1. The property is zoned R-1, Single Family Residential. <br /> 2. The property is guided in the Comprehensive Plan for Low Density Residential. <br /> 3. The property is legally described as follows: <br /> The East 335.35 feet of the South 66.15 feet of the North 330.74 feet of the Southwest <br /> Quarter of the Southeast Quarter of the Southeast Quarter of Section 18, Township 30 <br /> North, Range 23 West, subject to rights of public over the East 33 feet thereof for road <br /> purposes. <br /> 4. The applicant has proposed to construct an addition to the rear of the home, as well as other <br /> interior and exterior improvements. <br /> 5. The existing front yard setback is approximately 26' where 30' is normally required. <br /> 6. The existing southerly side yard setback is approximately 4' where 5' is normally required. <br /> <br /> 7. The Planning Commission and City Council considered the proposed Nonconforming Use <br /> Permit in accordance with Zoning Code Section 8-460, which identified Type 4 <br /> nonconformities. <br /> 8. The Planning Commission and City Council determined that the nonconformity couldn't be <br /> reduced or eliminated but that the proposed improvements would not increase the <br /> nonconformity or negatively impact adjacent property. <br /> Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Nonconforming Use Permit (NC2007-006) is hereby approve. <br /> <br /> <br /> • <br /> <br /> <br /> <br /> l:\COLJNCIL\REPORTS\2007"Community Development\I 1-27-2007\NC2007-006 (Norell) - RESOLUI ION.doc <br />
