<br /> <br /> Approved <br /> <br /> <br /> ANNING COMMISSION PROCEEDINGS <br /> I'Y OF NEW BRIGHTON <br /> <br /> Special Meeting - October 16, 2007 at 7:00 p.m. <br /> <br /> Present: Commissioners Larry Baker, Bruce Howard, Jim O'Brien, Karen Mann, and Paul Zisla. <br /> Absent: Tom O'Keefe and Norm Schiferl. <br /> <br /> Also Present: Sharon Doffing, Council Member, and Janice Gundlach, City Planner. <br /> <br /> Agenda Review: Agenda approved, <br /> Minutes: Minutes for October 2, 2007 were approved. <br /> <br /> Council Action; Council Member Doffing reported at the last Council meeting a sixth Life Saving Award was <br /> issued awarded and Al Bauer, who retired after thirty-six years with the City, was recognized for his dedication <br /> to the City. The Council has approved Transoma and a letter of understanding was reached with MT Properties <br /> for the Butcher's Spur. In addition, the Phase Two Soil Correction was tabled and will be discussed at the next <br /> Council meeting. <br /> <br /> Public Hearings: VN2007-003 & NC2007-004 Variance and Nonconforming Use Permit to Allow a Front <br /> Intro Addition and Rear Yard Deck for 1325 Pike Lake Court <br /> <br /> c applicants are requesting a Variance in order to construct a front entry addition that would include a new <br /> 16set and half bath. The front entry would be setback 29 feet from the front lot line where 30 feet is normally <br /> required. It should be noted, however, that the front entry addition is located in a manner where an existing gap <br /> in the foundation would be converted to livable space where currently it's an open stoop with roof overhang <br /> above. The front entry would not get any closer to the front lot line than the current home but because it is <br /> considered new structure, a Variance must be approved. <br /> <br /> In addition to the requested Variance, a Nonconforming Use Permit is required as the north end of the home is <br /> setback 20 feet from the front lot line where 30 feet is required. Approval of a Nonconforming Use Permit <br /> would allow the applicant to proceed with a deck addition, pending approval of the Rice Creek Watershed <br /> District (IZCWD). The proposed deck meets all city-required setbacks. The RCWD must determine whether <br /> the deck can be placed within the 50 foot setback required for Pike Lake. <br /> Staff has met and/or corresponded with the applicants over the last year due to the nonconforming nature of <br /> their lakeshore lot. The applicants expressed interest in what kinds of improvements could be made to the home <br /> and what would be required from the City. The applicants began demolition of the existing stoop in preparation <br /> for the front entry addition, believing no land use approvals were necessary as the addition would be within an <br /> existing roof overhang. However, staff informed them that a Variance and Nonconforming Use Permit would <br /> b, required. <br /> <br /> INlotion by Baker, second by O'Brien to CLOSE THE PUBLIC HEARING. <br /> <br /> 5 ayes, 0 nays.
