<br />d <br />II, <br />III <br />; I <br /> <br />\. - - ".f <br /> <br />1 <br /> <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION NOD5-049 <br /> <br />RESOLUTION TO ACCEPT SPECIAL APPROPRIATION FROM THE STATE <br />OF MINNESOTA FOR RELOCATION OF INTERCEPTOR SEWER LINE <br /> <br /> <br />REAS, the City of New Brighton ("City") is a municipal corporation and subdivision <br />f the State of Minnesota organized and operating under Minnesota law, and is authorized <br />y Minn. Stat. S 412.211, ~ 465.01 and Ch. 469 to acquire real estate by exercising the <br />ower of eminent domain under and pursuant to Minn. Stat., Ch. 117; and <br /> <br />REAS, the City Council of the City of New Brighton is the official governing body of <br />e City of New Brighton; and <br /> <br />REAS, pursuant to Minn. Stat. Ch. 469, the City has the authority to establish <br />evelopment districts and to create, undertake and complete development projects therein; <br />nd <br /> <br />HEREAS, the City Council established Development District No. 1 (the "Development <br />istrict") on December 221 1981, and thereafter enlarged it; and <br /> <br />HEREAS, the approximately 100 acres of real estate located immediately north of 1-694 <br />nd immediately west of I-35W, commonly known as the Northwest Quadrant (hereinafter, <br />'NWQ"), has been designated by the City Council as a high priority area for redevelopment; <br />nd <br /> <br />REAS, the size and strategic location of the NWQ provides a substantial development <br />pportunity for the Twin Cities metropolitan area; and <br /> <br />REAS, the City has incurred and expects to continue to incur substantial costs related <br />o the acquisition of properties, physical and economic planning, and environmental <br />ssessrnent and cleanup for the successful redevelopment of the NWQ; and <br /> <br />REAS, the Metropolitan Council operates an interceptor sewer line that transverses the <br />A; and <br /> <br />REAS, the location of the interceptor sewer line and the associated easement does not <br />allow efficient redevelopment; and <br /> <br />REASI the legislature of the State of Minnesota considered and approved a special <br />appropriation for the relocation of the interceptor sewer through the Northwest Quadrant; <br /> <br />i I: <br />I; :1 <br />d <br />
