11'1 \, ;1 :1 .l " ,I CITY COUNCIL CITY OF NEW BRIGHTON RESOLUTION NO. 05-048 RESOLUTION TO ACCEPT 2005 GRANTS FROM THE U.S. ENVIRONMENTAL PROTECTION AGENCY FOR CONT AMINA nON ASSESSMENT AND REMEDIATION REAS, the City of New Brighton ("City") is a municipal corporation and subdivision f the State of Minnesota organized and operating under Minnesota law, and is auth01ized y Minn. Stat. S 412.211, S 465.01 and Ch. 469 to acquire real estate by exercising the ower of eminent domain under and pursuant to Minn. Stat., Ch. 117; and REAS, the City Council of the City of New Brighton is the official governing body of he City of New Brighton; and REAS, pursuant to Minn. Stat. Ch. 469, the City has the authority to establish development districts and to create, undertake and complete development projects therein; and WHEREAS, the City Council established Development District No.1 (the "Development District") on December 22, 1981, and thereafter enlarged it; and WHEREAS, the City has incurred and expects to continue to incur substantial costs related to the assessment and remediation of environmental contamination on properties acquired for redevelopment purposes; and WHEREAS, the U. S. Environmental Protection Agency offers grant programs to assist in defraying a portion of costs for assessment and cleanup of contaminated properties; and WHEREAS, the City Council approved the submission of three applications for funding under these programs in the year 2004, which were approved by the funding agencies; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New Brighton, Minnesota that the City Council hereby accepts three grants totaling $600,000 from the U. S. Environmental Protection Agency, all awarded in the year 2005, with gratitude, on behalf of the City.
