<br />~ <br /> <br />b. That the special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />c. That the establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding <br />property for uses permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />e. That the special use shall, in all other respects, conform to the <br />applicable regulations of the district in which it located. <br /> <br />5. The Planning Commission found that the special use standards satisfied and <br />recommended approval to the City Council. <br />6. The City Council considered the request and approved the special use permit. <br /> <br />BE IT FURTHER RESOLVED I the application SPOS-ll & LPOS-07 is hereby approved with the <br />following conditions: <br /> <br />1. Compliance with SP04-01 and LP03-08 <br /> <br />2. A special use permit is applied for to consider signage through the <br />comprehensive sign plan process. <br /> <br />3. The storage of any packaging, garbage or recycling material shall not be stored <br />outside of the dumpster enclosure area as depicted on the site plan. <br /> <br />4. Garden Sales Area items shall be stored only in the "garden center" area as <br />depicted on the April 29, 2005 amended site plan. <br /> <br />5. Items within garden sales area shall not be stacked above the 6 foot masonry wall <br />or fenced area nor be visible from Old Highway 8 NW. <br /> <br />6. Outdoor "Garden Sales area" can include shrubs, fountains, bagged materials <br />such as soils and manure, mulches, trees, and small utility sheds located against <br />wall which shall not exceed 120 sq. ft. and power equipment. <br /> <br />7. The entire Garden Sales area shall be fenced; arborvitae shall be densely planted <br />for screening of the entire length on the west side facing Old Highway 8 NW. <br /> <br />8. Trees over 6 feet may extend above the screening. <br /> <br />9.
