<br />I I <br />n <br /> <br />.11> <br /> <br />I " <br />" <br /> <br />RESOLUTION No. 05-041 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />SOLUTION MAKING FINDINGS OF FACT AND APPROVING OF PL 05-02. <br /> <br />HEREAS, an application for a Minor Subdivision has been made by Mr. John Ordway to split the <br />existing lot at 500 5th A venue NW into two lots of record. <br /> <br />HEREAS, the procedural history of the application is as follows: <br />1. An application for a minor subdivision was filed with the City of New Brighton on April <br />9,2005; <br />2. Forty-six (46) letters were sent to the surrounding property owners within 350 feet of the <br />subject properties notifying them of the proposed split and public hearing; <br />3. Notice of Public Hearing was published in the New Brighton Bulletin. <br />4. The City Council considered the application and voted to approve the request on May 10, <br />2005; and <br /> <br />OW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />PL 05-05: <br />1. <br />2. <br />3. <br />4. <br /> <br />5. <br /> <br />The subject site is zoned B-4, Downtown Business. <br />The resulting lot split will result in a net total of one additional commercial lot in the City. <br />The resulting split will not create any non-confonnities with the Zoning Code. <br />As specified in Section 26-31 (5) of the New Brighton City Code, the City Council held a <br />Public Hearing. <br />The site is proposed to be divided into to three lots: <br />Parcel A 1 is proposed to be 55,063 ft.? <br />Parcel B is proposed to be 36,674 ft.2 <br /> <br />6. The legal description is as per Attachment A. <br /> <br />1.
