<br />..! <br /> <br />, <br />" <br />" <br />I: ~: <br />, <br /> <br />RESOLUTION No. 05-036 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF A SPECIAL USE PERMIT AND SITE <br />PLAN REVIEw. <br /> <br />WHEREAS, an application has been made by Mr. Greg Chaffin, ofT.J. Holdings, LLC. to be <br />considered for a Special Use Pennit and Site Plan Review SP05-10 & LP05-06. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Site Plan Review and Special Use Permit was filed with the City <br />of New Brighton on April 6, 2005 <br /> <br />2. The Planning Commission considered the request and held a public hearing on April <br />19,2005 and all present were given the opportunity to be heard. <br /> <br />3. The Planning Commission recommended approval to the City Council for the site plan <br />and special use permit. <br /> <br />4. The City Council considered the application on April 26, 2005. <br /> <br />WHEREAS, the City Council makes the following Findings of Fact in respect to SP05-10 & LP05- <br />06: <br /> <br />1. The site is zoned MX, Mixed Use. <br />2. The Subject Site is 43,524 sq. ft. <br />3. Plans show a mixed-use building over 40 feet. <br />4. Buildings over 40 feet are required to obtain a special USe permit. <br />5. The Planning Commission held a public hearing for a special use permit to <br />consider the building height over 40 feet on April19, 2005 and all persons were <br />given the opportunity to be heard. <br />6. Buildings with proposed heights greater than 40 feet in the MX Zoning district <br />are required to obtain a Special Use Permit and meet the standards found in <br />Section 6-550: <br />a. All buildings that are located on sites adjacent to Long Lake <br />Regional Park shall take advantage of the views to Long Lake and <br />shall provide site improvements that compliment the nanrral features <br />of Long Lake Regional Park. <br />b. All developments shall provide pedestrian linkages to Long Lake <br />Regional Park and neighboring developments for residents, <br />employees, and shoppers, and provide integrated parking and transit <br />elements whenever practical. <br />c. All uses shall be complementary or integrated and buildings shall be <br />related or connected in accordance with the vision of the adopted <br />Highway 8 Corridor Study. <br />d. All buildings and building sites shall be designed to encourage social <br />interchange and a sense of community, provide sufficient residential <br />amenities, and mitigate any adverse impacts of business and <br />industrial uses on residential uses. <br />3. The Planning Commission found that the standards in Section 6-550 were met <br />and recommended approval to the City Council. <br />4.
