a <br />`i <br />RESOLUTION NO. 05-023 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />{ PCESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF PL 05-02. <br />JWHEREAS, an application for a Minor Subdivision has been made by Mr. Bill Buelow to split the existing <br />lot at 790 1" Street NW into three lots of record. <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a minor subdivision was filed with the City of New Brighton on <br />February 24, 2005; <br />j 2. Fifty-six (56) letters were sent to the surrounding property owners within 350 feet of the <br />subject properties notifying them of the proposed split and public hearing; <br />3. Notice of Public Hearing was published in the New Brighton Bulletin. <br />4. The Planning Commission held a Public Hearing and considered the proposal at its March <br />15, 2005 meeting and all present were given the opportunity to be heard; <br />5. The City Council considered the application and voted to approve the request on March <br />22, 2005; and <br />Now THEREFORE BE IT RESOLVED, the Planning Commission makes the following Findings of Pact in <br />respect to PL 05-02; <br />1. The subject site is zoned R-IA, Single Family Residential, <br />2. The resulting lot split will result in a net total of two additional single family lots in the City. <br />3. The resulting split will not create any non-conformities with the Zoning Code. <br />4. As specified in Section 26-31(5) of the New Brighton City Code, the Planning Commission <br />held a Public Hearing. <br />s 5. The site is proposed to be divided into to three lots: <br />Parcel 1 is proposed to be 8,563 ftz <br />Parcel 2 is proposed to be 5,516 ft2 <br />Parcel 3 is proposed to be 5,519 ftz <br />6. The legal description is as per Attachment A. <br />13E IT FURTHER RESOLVED, that based upon the above findings of fact, the application PL 05-02 is <br />hereby approved with the following condition: <br />1. The applicant shall test the suitability of the soils for home construction to the satisfaction of the <br />City Engineer. <br />Adopted this 22nd day of March, 2005. <br />TT: ? C <br />Daniel A.
