<br />~ <br /> <br />j I <br />~ .' <br />-.III <br /> <br />.~ <br /> <br />, <br /> <br />""'.- <br /> <br />RESOLUTION No. 05-014 <br />8T A TE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />JmSOLUTION MAKING FINDINGS OF FACT AND ApPROVING NCOS.02 and LPOS.02: <br /> <br />WHEREAS, an application has been made by the MWF Properties to be considered for a Type 4 Non- <br />conforming Use Permit and Site Plan review to construct 22 garages at 219 Old Highway 8 SW. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a type 4 non-conforming use permits and site plan review was filed <br />with the City of New Brighton on January 18,2005. <br /> <br />2. On February 15,2005, the Planning Commission held a public hearing and all present <br />were given an opportunity to be heard. <br /> <br />3. The Planning Commission recommended conditional approval to the Council. <br /> <br />4. On February 22,2005, the Council considered the non-conforming use pennit and site <br />plan. <br /> <br />; <br /> <br />WHEREAS, the City Council makes the following Findings of Fact in respect to NCOS-02 and LP05.02: <br /> <br />1. The subject site is zoned R-3B, Multi-Family Residential. <br /> <br />2. The proposed use is allowed in the R-3B zoning district. <br /> <br />3. The future use for the site is High Density Residential; and the proposed use is <br />consistent with New Brighton Comprehensive Plan. <br /> <br />4. The applicant is requesting a Type 4 Non-conforming Use Permit to construct 4 <br />detached garage structures. <br /> <br />5. A Type 4 Non-conforming use permit is required for the City to review the site plan. <br /> <br />6. Where Type 4 nonconfonnities are present and are proposed to continue, expansion of <br />the existing structure, construction of new structures, or resumption of use after <br />discontinuance of use for six or more months shall be allowed only upon permission of <br />the City Council <br /> <br />7. As specified in Section 8-460 (2) of the New Brighton Zoning Ordinance, no Type 4 <br />Nonconforming Use Permit shall be granted unless one or more of the following <br />conditions are met : <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconformities upon adjacent premises is reduced to the <br />greatest practical extent. <br />c. The extent of any nonconformity is reduced where practical. <br /> <br />8. The Planning Commission held a public hearing on February 15,2005 and reviewed the <br />application and recommended approval to the City Council. <br />9.
