<br />... <br /> <br />\,i <br /> <br /> <br />':. ,~ <br /> <br />'! ,: <br /> <br />RESOLUTION No. 05-015 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />, i <br />~SOLUTION MAKING FINDINGS OF FACT AND ApPROVING OF A MINOR SUBDIVISION PL04-04 <br />I <br />~ i <br /> <br />, I <br />WHEREAS, an application has been made by the MWF Properties for a minor subdivision at 219 <br />" <br />I i Old Highway 8 SW. <br />I <br /> <br />I, <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br /> <br />1. An application for minor subdivision and site plan review was filed with the City <br />of New Brighton on December 2, 2004 <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on January 18,2005, and all persons present at the hearing were given an <br />opportunity to be heard. <br /> <br />3. On January 18,2005, the Planning Commission tabled consideration of the <br />application pending receipt and review of a Type 4 Non-conforming Use permit to <br />address concerns on the existing 219 Old Highway 8 SW site. <br /> <br />4. MWF Properties submitted a site plan and Type 4 Non-conforming Use permit; the <br />Planning Commission held a public hearing and recommended conditional <br />approval to the Council <br /> <br />5. On February 15,2005, the Planning Commission, pursuant to published and mailed <br />notices, held a public hearing and all persons present at the hearing were given an <br />opportunity to be heard. <br /> <br />6. The Planning Commission considered the lot split and preliminary plat and <br />recommended that the Council approve the application PL04-04. <br /> <br />7. On February 22,2005, the Council considered the preliminary plat. <br /> <br />Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />PL04-04 is hereby approved subject to the following conditions: <br /> <br />1. Compliance with LP04-07. <br />2. Approval of a Permit from the Ramsey County Department of Transportation for <br />the proposed new curb cuts on Old Highway 8. <br />3. Approval of the County Engineer for the proposed plat. <br />4. A drainage easement is drafted on the final plat for the new pond and storm sewer. <br />5. A trail easement is provided to connect Old Highway 8 and Jones Lake and an <br />easement agreement is approved by the City Park and Recreation Director, the City <br />Planner, and the City Attorney. <br />6.
