<br /> I !I <br /> ~ "' <br />~ ~' <br /> <br />RJL-24 5vl <br />NE136- 3 <br /> <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION NO. 04-107 <br /> <br />RESOLUTION SUPPORTING THE TRANSFER OF SURPLUS LANDS AT <br />TCAAP FROM FEDERAL GOVERNMENT <br /> <br />. <br />WHEREAS, the City of New Brighton ("City") is a municipal corporatioJ;l and subdivision <br />of the State of Minnesota organized and operating under Mirmesota law, and is authorized <br />by Minn. Stat. ~ 412.211, ~ 465.01 and Ch. 469 to acquire real estate by exercising the <br />power of eminent domain under and pursuant to Minn. Stat., Ch. 117; and <br /> <br />WHEREAS, the City Council of the City of New Brighton is the official governing body of <br />the City of New Brighton; and <br /> <br />WHEREAS, the 24 acres of real estate located along the railroad. tracks in the northeastern <br />portion of the City is owned by the Federal government; and <br /> <br />WHEREAS, th~ Federal government has declared surplus this area and intends to offer it for <br />sale; and <br /> <br />WHEREAS, the City Council recognizes the possibilities for industrial and/or recreational <br />redevelopment <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />Brighton, Minnesota that the City Council hereby supports the acquisition of up to 24 acres <br />ofland in the northeastern portion of the City, from the Federal government; and <br /> <br />BE IT FURTHER RESOLVED that the City Council directs staff to continue discussions <br />with the appropriate Federal agency about the acquisition of the property and for its intended <br />reuse for economic, industrial, transportation, and public recreational trail purposes_ <br /> <br />Adopted by the City Council of the City of New Brighton, Minnesota this 14th day of <br />December, 2004. <br /> <br />~_(/Y\ <br /> <br />ATTEST: <br />M?/i;.~(~1? - AdC{~:;<-- <br /> <br />Steve Larson, Mayor <br /> <br />::l"!ibw& ~ <br /> <br />Daniel Maiers, Finance Director/City Clerk <br />
