<br />H <br /> <br />., <br /> <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION NO. 04-096 <br /> <br />RESOLUTION TO ACCEPT 2004 GRANTS FROM THE ST ATE OF <br />MINNESOTA AND METROPOLITAN COUNCIL FOR CONTAMINATION <br />ASSESSMENT, REMEDIATION, AND PLANNING <br /> <br /> <br />HEREAS, the City of New Brighton ("City") is a municipal corporation and subdivision <br />f the State of Minnesota organized and operating under Minnesota law, and is authorized <br />y Minn. Stat. ~ 412.211, ~ 465_01 and Ch. 469 to acquire real estate by exercising the <br />ower of eminent domain under and pursuant to Minn. Stat., Ch. 117; and <br /> <br />EREAS, the City Council of the City of New Brighton is the official governing body of <br />e City of New Brighton; and <br /> <br />EREAS, pursuant to Minn. Stat. Ch. 469, the City has the authority to establish <br />development districts and to create, undertake and complete development projects therein; <br />and <br /> <br />WHEREAS, the City Council established Development District No, 1 (the "Development <br />District") on December 22, 1981, and thereafter enlarged it; and <br /> <br />WHEREAS, the approximately 100 acres of real estate located immediately north of 1-694 <br />and immediately west of 1-35W, commonly known as the Northwest Quadrant (hereinafter, <br />"NWQ"), has been designated by the City Council as a high priority area for redevelopment; <br />and <br /> <br />WHEREAS, the City Council has authorized the acquisition of many of the properties in the <br />NWQ; and <br /> <br />WHEREAS, the City has incurred and expects to continue to incur substantial costs related <br />to the acquisition of NWQ properties and associated remediation of environmental <br />contamination; and <br /> <br />WHEREAS, the City has incurred and expects to continue to incur substantial costs related <br />to the physical and economic planning for the successful redevelopment of the NWQ; and <br /> <br />WHEREAS, the State of Minnesota and Metropolitan Council offer grant programs to assist <br />in defraying a portion of costs for projects such as the NWQ; and <br /> <br />WHEREAS, the City Council approved the submission of three applications for funding <br />under these programs in the year 2004, which were approved by the funding agencies; <br /> <br />!i! <br />
