RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING NC04~03, SP04-13, and LP04-06. <br />I <br /> <br />I <br />I <br />i WHEREAS, an application has been made by Mina Adsit, Architect on behalf of Benedictine Health <br />: System for a Nonconforming Use Permit and Site Plan Review to construct an addition <br />I onto the existing Innsbruck Health Care Center building at 2800 1-694 Service Drive; <br />, and <br /> <br />; <br /> <br />I WHEREAS, the procedural history of the application is as follows: <br /> <br />I <br />1. An application for a nonconforming use pennit was filed with the City of New Brighton on <br />September 7, 2004. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on September 21, 2004 and all present were given a chance to freely speak at the hearing; <br />3. The City Council considered the request on September 28,2004; and, <br /> <br />Now THEREFORE BE IT REsOLVED, the City Council makes the following Findings of Fact in respect <br />to NC04-03, SP04-13, and LP04-06. <br /> <br />1. The subject site is zoned R-3B, Multi-family Residential and the future land use is P-QP, <br />Public-Quasi Public. <br /> <br />2. Both the Zoning Code and Comprehensive Plan support the use existing and proposed for <br />the site. <br /> <br />3. The applicant is proposing to construct an addition onto the existing building at 28001-694 <br />Service Drive. <br />4. Required screening of off street parking areas along the east lot line is not provided for and <br />the south parking area and southwest corner of the existing building encroach into the front <br />yard setback; all three are Type 4 Non-confonmties. <br />5. As specified in Section 8-610 of the New Brighton Zoning Ordinance, no Type 4 <br />Nonconforming Use Permit shall be granted unless one or more of the following conditions <br />are met: <br />a. The total number of nonconfonnities is reduced. <br /> <br />b. The impact of any nonconfonnities upon adjacent premises is reduced to the greatest <br />practical extent. <br />c. The extent of any nonconformity is reduced where practical. <br /> <br />6. The applicant has met the requirements for the off street parking screening issue in site plan <br />design. <br />7.
