An application for a special use permit was filed with the City of New Brighton on <br />'I <br />!' August 26, 2004. <br />I 2. The Planning Commission, pursuant to published and mailed notices, held a public <br />I hearing on September 21, 2004 and all present were given a chance to freely speak at <br />II the hearing; <br />!I 3. The Planning Commission recommended conditional approval to the Council; and, <br />j 4. On September 28,2004, the New Brighton City Council considered the application. <br />I <br /> <br />I Now THEREFORE BE IT RESOLVED, the Council makes the following Findings of Fact in <br />II respect to SP 04-12: <br />ij <br /> <br />II <br />II <br />I <br /> <br />~ - ,. <br /> <br />RESOLUTIOJ'q No.04-083 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />The subject site is zoned R-l A, Single Family Residential. <br /> <br />The applicant is requesting a Special Use Permit to construct an addition on to an <br />existing garage. <br /> <br />The total size proposed is 1,064 square feet. <br /> <br />Garages larger than 624 [1.2 in size are required to obtain a Special Use Permit. <br /> <br />As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use <br />shall be recommended by the Planning Commission unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br />That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />I c. That the establishment of the special use will not impede the normal and orderly <br />I development and improvement of the surrounding property for uses permitted in <br />!: the district. <br />;i d. That adequate utilities, access roads, drainage andlor necessary facilities have been <br />: i or are being provided. <br />I: <br />Ii e. That the special use shall, in all other respects, contonn to the applicable <br />Ii regulations of the district in which it located. <br />II, 6. The City Council finds the special use standards satisfied. <br /> <br />II 7. Section 4-530 (1) K requires that accessory buildings exceeding 624 square feet in size <br />ii shall be subject to compliance with the following conditions: <br />,I <br />I! 1.
