<br />1'1' <br />I' <br /> <br />" ~ <br />:i <br />'I <br /> <br />~. <br /> <br />f' '- ~ 'L' <br /> <br />i' <br />I: <br />:1 <br />H <br />II <br />Ii <br />Ii <br />;\ <br />II RESOLUTION No. 04-081 <br />q CITY OF NEW BRIGHTON <br /> <br />Ik:sOLUTION MAKING FINDINGS OF FACT AND ApPROVING SP 04-11. <br /> <br />IkHEREAS, an application for a special use permit has been made by Mr. Paul Schweppe to construct a 843 <br />I r . square foot garage located at 1227 12th Ave NW; and <br />II <br />'I <br />l}vlIEREAS, the procedural history of the application is as follows: <br /> <br />" <br /> <br />II 1. An application for a special use permit was filed with the City of New Brighton on August 26, <br />!l 2004. <br />'i 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />III September 21, 2004 and all present were given a chance to freely speak at the hearing; and, <br />II 3. The City Council considered the request at their regular meeting on September 28, 2004. <br /> <br />~OW THEREFORE BE IT RESOLVED, the Planning Commission makes the following Findings of Fact in <br />~espect to SP 04.11: <br />II 1. The subject site is zoned R-l, Single Family Residential. <br /> <br />1i 2. The applicant is requesting a Special Use Permit to construct an addition on to an existing <br />!I <br />I i garage. <br />I! 3. The total size proposed is 843 square feel. <br /> <br />II 4. Garages larger than 624 f1.2 in size are required to obtain a Special Use Permit. <br /> <br />II,' 5. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall be <br />!; recommended by the Planning Commission unless such shall find: <br /> <br />II a. That the establishment, maintenance, or operations of the special use will not be <br />I! detri~ental to or endanger the public health, safety, morals, comfort of general <br />II pubhc. <br />1! b. That the special use will not be injurious to the use and enjoyment of other <br />i i property in the immediate vicinity for the purposes already pennitted, nor <br />H substantially diminish and impair property values within the neighborhood. <br />:1 c. That the establishment of the special use will not impede the normal and orderly <br />'I development an<~ improvement of the surrounding property for uses permitted in <br />i, <br />11, the district. <br />.' d. That adequate utilities, access roads, drainage and/or necessary facilities have been <br />>i <br />Ii or are being provided. <br />II e. That the special use shall, in all other respects, conform to the applicable <br />!! regulations of the district in which it located. <br />. I 6. The City Council finds the special use standards satisfied. <br />Ii <br />:; 7. The City Manager has determined that the site meets the yard designation requirements in <br />; ~ <br />'I Section 2-020 (76) A. <br />" <br /> <br />Ii 8. The lake side of 1227 12th Avenue NW is designated as the front yard; a detached accessory <br />Ii <br />i' structure shall be pennitted on the street side of the parcel. <br />i! <br />d 9. The accessory structure meets the yard setback requirements for a detached accessory structure <br />i i on the street side of the lot. <br />H <br />: 1 10.
