I <br />~SOLUTION MAKING FINDINGS OF FACT AND ApPROVING SP 04.08. ! <br /> <br />LHEREAS. an application for a special use permit has been made by Mr. Chad Wicklund to constructl <br />ir. a 576 square foot garage located at 2650 County Rd. E and ! <br />Ii <br />" <br />il I <br />fHEREAS' the procedural history of the application is as follows: I <br />I ' <br />, I <br /> <br />! Ii 1. An application for a special use permit was filed with the City of New Brighton on July I <br />L 1,2004. ! <br />il 2. The Planning Commission, pursuant to published and mailed notices, held a public I <br />~i ~~~~~;on July 20,2004 and all present were given a chance to freely speak at the ! <br /> <br />, 3. On July 27th, the Council considered the request and approved the application; and, I <br /> <br />, OW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in II' <br />I; respect to SP 04.08: I <br /> <br />,I 1. The subject site is zoned R-1, Single Family Residential. <br />Ii 2. The applicant is requesting a Special Use Permit to construct a 616 square foot garage. ! <br />II 3. Garages larger than 400 ft.2 in size are required to obtain a Special Use Permit. i <br />Ii 4. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use I <br />Ii shall be recommended by the Planning Commission unless such shall find: I <br /> <br />11 <br />Ii a. That the establishment, maintenance, or operations of the special use will not ! <br />I' <br />'I be detrimental to or endanger the public health, safety, morals, comfort of <br />general public. <br />That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already pennitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />That the establishment of the special use will not impede the nonnaI and <br />orderly development and improvement of the surrounding property for uses <br />permitted in the district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br />That the special use shall, in all other respects, confonn to the applicable <br />regulations of the district in which it located. <br /> <br />b. <br /> <br />c. <br /> <br />d. <br /> <br />e. <br /> <br />The City Council finds the special use standards satisfied. <br />
