Mr. James Faulkner, Architect, on behalf of Doug DuFresne for an expansion to the existing! <br />Ii Assembly, Packaging, & Screen Printing facility at 750 1st S1. SW. <br />:l <br /> <br />iIWHEREAS, the procedural history of the application is as follows: <br />:1 1. On May 24, 2004, an application was received by the City of New Brighton, <br />;1 2. On June 15, 2004, a public hearing was held by the Planning Commission and all presen. <br />,I ; <br />!j were given a chance to be heard. i <br />!i 3. At the regular meeting on June 22,2004, the New Brighton City Council re-opened the <br />: public hearing to provide additional opportunity for interested parties a chance to speak <br />tl <br />about the application. <br />4. The Council approved the site plan and type 4 non-conforming use permit applications. <br /> <br />:1 <br /> <br />,. <br /> <br />~' I <br />i! <br />IINOW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Factin <br />Ii respect to NC04-02 & LP04-04: <br />II 1. The site is zoned 1-2, Heavy Industrial. <br />II 2. The future land use for the site is ill, Heavy Industrial in the Comprehensive Plan. <br />:1 3. Existing and proposed use is consistent with the zoning code and the future land use. <br />Ii 4. The applicant is proposing to construct a 14,000 square foot addition onto the existing <br />11 building at 750 1st Street NW. <br />:1 5. The site has the following non-conformities: <br />ij a. parking area does not have curb and gutter and encroaches into the front yard <br />i I setback; <br />:J <br />b. the existing structure encroaches into the rear yard setback; <br />c. the landscaping is dead or missing; and, <br />d. outdoor storage is not screened from the right-of-way. <br /> <br />I) <br />;; <br /> <br />i <br /> <br />" <br />I <br /> <br />6. The four conditions listed above are type 4 nonconformities. <br />7. As specified in Section 8-610 of the New Brighton Zoning Ordinance, no Type 4 <br />Nonconforming Use Permit shall be granted unless one or more of the following <br />conditions are met: <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconformities upon adjacent premises is reduced to the <br />greatest practical extent. <br />c. The extent of any nonconformity is reduced where practical. <br />8. The Planning Commission considered the application and found that the conditions above <br />were met and recommended approval to the City Council. <br />9. The Council considered the request within regulations found in Section 8-610 and finds <br />the type 4 nonconforming use standards satisfied. <br />10. Public hearing notice went out to the surrounding sixteen (16) properties within 350 feet <br />and published in the New Brighton Bulletin. <br />11.
