<br />". <br /> <br />" <br /> <br />RESOLUTION No. 04-044 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FlNDINGS OF FACT AND ApPROVING OF A SlTE PLAN AND SPECIAL USE <br />PERMIT; <br /> <br />WHEREAS, an application has been made by the City of New Brighton to be considered for a Site Plan <br />review and a Special Use Permit for a salt and sand storage facility at 700 5th Street NW. <br /> <br />, <br />, . <br />i; <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Site Plan Review was filed with the City of New Brighton on April 30, <br />2004. <br />2. The Planning Commission held a public hearing and review the application on May 18,2004. <br />3. The Commission considered the plans and recommended approval to the City Council. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact in respect to SP04-02 and LP04- <br />03: <br /> <br />1. <br />2. <br />3. <br />4. <br /> <br />The site is zoned 1-2, Heavy Industrial. <br /> <br />The expanded use is permitted in the zone. <br /> <br />The expansion will be 6,300 sq. ft. 35 ft. in height <br /> <br />Structures that store road treatment materials are required to obtain a Special Use <br />Permit. <br /> <br />As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use <br />shall be recommended by the Planning Commission unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, comfort <br />of general public. <br />b. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for uses <br />permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities <br />have been or are being provided. <br />e. That the special use shall, in all other respects, conform to the applicable <br />regulations of the district in which it located. <br />The Planning Conunission held a public hearing on May 18,2004 and considers <br />standards satisfied and recommended approval to the Council. <br />On May 25, 2004, the City Council found the special use standards satisfied. <br /> <br /> <br />5. <br /> <br />6. <br /> <br />, I <br />, , <br /> <br />7. <br /> <br />BE IT RESOLVED, the application SP4-02 and LP04-03 is hereby approved by the City Council with <br />the following condition: <br /> <br />1.
